Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Custom Case Specific Condition
Wording 1. New utility distribution lines shall be placed underground wherever reasonable and practical. 2. Utilities and transportation facilities shall be installed in the same rights-of-way when the effect will be to reduce the adverse impacts on the physical environment. 3. It shall be the affirmative duty of the applicant who proposes a minor utility development to determine if any state or federal permits or licenses are necessary and then to obtain those permits or licenses at their own expense. 4. The applicant shall obtain a permit from the Jefferson County Department of Public Works to place water lines within County rights-of-way. 5. The applicant shall receive a Franchise Amendment from the Washington State Department of Transportation to place water lines within State rights-of-way. 6. Substantial progress towards completion of the project shall be performed within two years of the issuance of the permit. 7. Water lines shall be located a minimum of 10 feet from all onsite sewage system components. Where a water line and wastewater line cross, the water line shall be placed above the wastewater line a minimum of 18 inches. If this separation cannot be maintained and the water line is still above the wastewater line, the water line shall be cased. If the water line is below the wastewater line then both lines shall be cased. All casing shall meet the standards set forth in the DOE Criteria for Sewage Works. It is the responsibility of the applicant to locate any drainfields or wastewater lines that they will be coming into proximity with or crossing. 8. The applicant shall implement the pollution and erosion control measures listed in Section 5.2 of the Aquatic Resources Impact Assessment prepared by Parametrix and date May 2006. 9. The applicant shall contact Public Works and schedule a pre-construction meeting and implement the Stormwater Pollution Prevention Plan as approved by Public Works. 10. The applicant shall immediately restore the installation sites to their per-project condition to the maximum extent possible. 11. Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. Waters of the state include but are not limited to waters in roadside ditches and storm drains. 12. Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent stormwater runoff from carrying soil and other pollutants into surface water or storm drains that lead to waters of the state. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants. 13. Soil in stockpiles should be stabilized or protected with sediment-trapping measures to prevent soil loss. All exposed areas of final grade or areas that are not scheduled for work, whether at final grade or otherwise, shall not remain exposed and un-worked for more than two days, between October 1 and April 30. Between May 1 and September 30, no soils shall remain exposed and un-worked for more than 7 days. 14. Source control best management practices such as plastic covering, mulch, temporary seeding, and phased clearing (for example) should be used to control erosion during construction. More examples of effective source control Best Management Practices can be found in the Washington Department of Ecology's Stormwater Management Manual for Western Washington (2001). 15. During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products, paints, solvents, and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills should take precedence over other work on the site. 16. A conditio
