Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-HISTORY
Wording A Shoreline Exemption Permit (SDP06-12) was issued on June 26, 2006 and subsequent permits SDP07-00039 & SDP08-00040. Because a shoreline exemption is only valid for one year (SMMP- Section 18.25.080 of the Jefferson County Code) this permit is required even though the HPA from WDFW, Water Quality Certification from the DOE, and the Section 10 & 404 Permits from the U.S. Army Corp of Engineers may be granted for a longer period for this maintenance dredging activity.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on May 21, 2007 for the potential presence of Environmentally Sensitive Areas under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review, the following ESAs were confirmed to be present on the subject property: Fish and Wildlife Habitat Areas Conservancy - Aquatic Shore Designation (overwater-marine).

Title: F-HPA Issued
Wording The Washington Department of Fish and Wildlife issued Hydraulic Project Approval (HPA) for this activity on September 16, 2011 under Control Number 123964-1. The HPA expires on September 16, 2016.

Title: F-DNS Issued
Wording The proposal has received review under the State Environmental Policy Act (SEPA) through a Final Mitigated Determination of Non-Significance issued by Jefferson County on June 2, 1999. The mitigation measures are address through existing development regulations and required permits. This threshold determination was for routine maintenance dredging of the marina access channel of accumulated sediments and disposal on an approved upland location. Because the proposal has not changed significantly from what was analyzed through the previous threshold determination, no additional SEPA review is required for this proposal (WAC 197-11-800).

Title: F-Site Plan Changes
Wording The site plan as submitted with the Shoreline Exemption application on April 23, 2012 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated May 29, 2012 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for removal of approximately 1000 cubic yards of sediment from the marina access channel (maintenance dredging) and routine maintenance to existing docks, ramps, and infrastructure related to the marina only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Jefferson County Shoreline Managment Master Program, Section 18.25.090(6) of the Jefferson County Code, and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
