Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Other Work/Separate Approval
Wording Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department.

Title: Site Plan
Wording Construction shall be in substantial compliance with the site plan submitted on November 19, 2008 as it exists now or is hereafter amended by Jefferson County and/or the Washington Department of Ecology.

Title: Exempt Maintenance Condition
Wording The development shall be essentially the same as the original in location, size, configuration, and external appearance.

Title: No Fill or Other Material
Wording No fill or other material may be placed in the waters or intertidal areas of Jefferson County.

Title: SPILL CONDITION
Wording A Spill Prevention Control and Countermeasures Plan shall be developed prior to beginning any work within 200 feet of a stream, wetland, or marine waters. A complete copy of the Spill Prevention Control and Countermeasures Plan shall be kept at all work areas during constuction.

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: Hydraulic Code/HPA Check
Wording Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state.

Title: Army Corps Check
Wording Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers (COE) in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands. Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-WL & RARE PLANT FINDING
Wording Wetlands and rare plants have been identified in the vicinity of the project area. Work is to be conducted within WSDOT right-of-way; therefore, no impacts to wetlands or rare plants are anticipated.

Title: F-FLOOD FINDING
Wording The proposal is maintenance of existing U.S. Highway 101 pavement. The proposed project is expected to be resistant to flood damage and would not be expected to affect flood levels. The proposal complies with JCC 15.15 (Flood Damage Prevention).

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on February 26, 2009 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review, the following ESAs were identified within the project area: Fish and Wildlife Habitat Conservation Areas (streams, listed fish and wildlife habitat, priority habitat and species), wetlands, and rare plants.

Title: F-Streams
Wording Streams (Fish and Wildlife Habitat Conservation Area) and associated buffers have been identified in the vicinity of the project area. Stream buffers shall be measured horizontally from the Ordinary High Water Mark (OHWM). The JARPA indicates that work will be conducted within 200 feet of Nolan Creek (which is a shoreline of the state), but no impacts to the stream are anticipated. A Spill Prevention Control and Countermeasures Plan will be developed to minimize the potential of impacting the stream.

Title: F-SEPA Exempt
Wording Washington State Department of Transportation acted as the lead agency for this project, which received a State Environmental Policy Act (SEPA) Categorical Exemption under WAC 468-12-800(1)(u) for maintenance of existing transportation pavement.

Title: F-Site Plan Changes
Wording The site plan as submitted with the shoreline exemption application on November 19, 2008 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated February 26, 2009 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-APPROVAL FOR SDP EX ONLY
Wording This approval is for a shoreline exemption for road maintenance on U.S. Highway 101 (MP 159.37 to MP173.72) only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Shoreline Master Program Chapter 18.25 JCC and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
