Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Other Work/Separate Approval
Wording Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department.

Title: Treated Materials Must be Cured
Wording All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance with the Best Management Practices approved by the Washington Department of Fish and Wildlife.

Title: Site Plan
Wording Construction shall be in substantial compliance with the site plan submitted on November 2, 2006 as it exists now or is hereafter amended by Jefferson County and/or the Washington Department of Ecology.

Title: Exempt Maintenance Condition
Wording The development shall be essentially the same as the original in location, size, configuration, and external appearance.

Title: No Fill or Other Material
Wording No fill or other material may be placed in the waters or intertidal areas of Jefferson County.

Title: WETLAND/STREAM BUFFER MITIGATION
Wording Measures to protect the wetland, stream, and associated buffers from construction-related activities are to be implemented based on recommendations included in the wetland report. To comply with JCC Chapter 18.15 ESA buffer mitigation requirements, re-vegetation of cleared and/or graded buffer area must be conducted as specified in provision 24 of the HPA.

Title: UTILITY LINE RELOCATION
Wording Re-location of utility lines beyond the project footprint is not allowed as part of this permit. Jefferson County must be contacted if existing utilities cannot withstand the anticipated settlement during embankment construction as re-location of utility lines may require other permits or approvals.

Title: GEOTECH LETTER
Wording A written letter will be submitted to Jefferson County DCD from the geologist/engineer who prepared the geotechnical report dated May 21, 2001, stating that the structure has been constructed in conformance with the requirements of the report. The letter shall be wet-stamped by the licensed geologist/engineer.

Title: Geotech Report Submitted
Wording A Geotechnical Report (dated May 21, 2001) was submitted in conjunction with this application. The report addressed seismicity and existing surface and subsurface conditions in the project area. The report provided geotechnical recommendations and construction considerations specific to the bridge replacement project. These recommendations and considerations are to be implemented as part of the bridge replacement project.

Title: Aquifer Recharge Conditions (SFR)
Wording Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin.

Title: Hydraulic Code/HPA Check
Wording Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state.

Title: Comply with HPA
Wording In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval.

Title: Army Corps Check
Wording Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers (COE) in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands. Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-LEGAL NON-CONFORMING
Wording The existing bridge was constructed prior to January 16, 2001 when the UDC became effective. JCC 18.15.215 states that an existing use may be repaired and maintained without limitation of the ESA section of the UDC.

Title: F-HPA & CORPS
Wording Issues related to over-water development activities (including materials, methods, timing, etc.) will be addressed by the Washington Department of Fish and Wildlife HPA and/or U.S. Army Corps of Engineers permit. An HPA was issued by WDFW on January 5, 2007 (Control Number: 107439-2). The HPA included construction and stream protection provisions specific to the project.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on January 2, 2007 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: conservancy shoreline designation, Type 3 stream, fish and wildlife habitat areas, wetlands, seismic hazards, susceptible aquifer recharge area, coastal seawater intrusion protection zone, and intermediate and modified shoreline slope stability.

Title: F-Special Report Submitted
Wording A Wetland Report was submitted in conjunction with the application. The report identified a Category I estuarine wetland along the shoreline. Category I wetlands are required to have a 150-foot-wide buffer. The report states that construction-related activities will avoid the wetland, but that approximately 1,660 square feet of wetland buffer will be impacted by the project. Project impacts would include the removal of two 8-inch diameter hemlock trees from the buffer. Recommended mitigation measures to minimize impacts to wetlands, vegetation, streams, and fish and wildlife habitats were also included in the report. A Geotechnical report, dated May 21, 2001 was prepared for the bridge replacement project. The report included geotechnical recommendations and construction considerations based on existing conditions in the project area. The geotechnical report also notes that the amount of settlement likely to occur during project construction may necessitate re-location of the existing utility lines.

Title: F-Aquifer Recharge Area
Wording Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County.

Title: F-Susc. Aquifer Recharge Area
Wording Susceptible Aquifer Recharge Areas are those areas with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers.

Title: F-Streams
Wording A Type 3 Stream (Fish and Wildlife Habitat Area) has been identified on the subject property. The stream requires a buffer of 100 feet. The buffer shall be measured horizontally from the Ordinary High Water Mark (OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established.

Title: F-Coastal SIPZ
Wording The project area is located within a coastal SIPZ (seawater intrusion protection zone) according to the County GIS map. A coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. No groundwater withdrawl is proposed as part of the project.

Title: F-DNS Issued
Wording The project was reviewed under the State Environmental Policy Act (SEPA) by Washington State Department of Transportation - Olympic Region acting as lead agency. A Determination of Non-Significance (DNS) was issued on August 16, 2006.

Title: F-Site Plan Changes
Wording The site plan, as submitted with the shoreline exemption application on November 2, 2006, has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan checked by B. Khaleghi in June 2001 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-APPROVAL FOR SDP EX ONLY
Wording This approval is for a shoreline exemption to replace an existing bridge at Walker Creek only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Shoreline Master Program Section JCC 18.25.090(6) and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
