Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: No Fill or Other Material
Wording No fill or other material may be placed in the waters or intertidal areas of Jefferson County.

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: Hydraulic Code/HPA Check
Wording Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. You should contact Tim Rymer with WA State Department of Fish & Wildlife regarding whether a Hydraulic Project Approval will be required. His Phone number is (360) 457-2719.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-ESA
Wording Because this activity was declared an emergency it is exempt from review of Environmentally Sensitive Areas under Section 3.6.4(f)(1)(i) of the Jefferson County Unified Development Code.

Title: F-NATURE OF PROPOSAL
Wording Slides occurring around September 20, 2004 have damaged the Highway 101 between milepost 184.08 to 184.38 along the Bogachiel River. No work would occur within the Bogachiel River, but work would occur adjacent to the river within 200 feet of the OHWM. The proposal includes installing horizontal drains, soil nails, shotcrete, geofoam, and a soldier pile wall, to stabilize the slide areas. The proposal also includes guardrail replacement and surfacing and paving to restore two lanes of traffic. No tree removal is anticipated and the project includes revegetating disturbed areas with native vegetation, hydroseeding, and erosion control measures. This project would re-establish the Highway 101 in its traditional location and to a similar condition that existed prior to the slide. The NOAA and USFW were notified about this proposal by WA State Department of Transportation.

Title: F-SEPA Exempt
Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(3), because it entails repair and maintenance of Highway 101.

Title: F-Site Plan Changes
Wording The site plan as submitted with the Shoreline Exemption application (SDP 04-48) on October 27, 2004 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated December 16, 2004 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for the repair of Highway 101 from Mile Post 184.08 to 184.38 only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Shoreline Master Program Section 3.402(6), which is normal repair and maintenance, and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements. Federal agencies conducting activities on federal lands are not required to obtain permits per Section 3.30 of the SMMP.
