Case Number  CAM2022-00140
Description  The property is the Old Oyster House restaurant. The restaurant has been unoccupied for the last 20 years and due to previous agreements is no longer allowed to be a restaurant. The 4,000 square foot building is adjacent to Discovery Bay right at the beach. The septic is pumped to a septic field that is privately owned by (the resort ?) in which the property is located. We would like to move in as a single family residence with as little structural changes as allowed by codes and regulations. What do we need to do to be able to purchase the property for that use and move in?

Description  We are considering in investing in restoring the old Oyster House building (Parcel ID: 901182035). I wanted to ask a few clarifying questions as I am digging through documents. 1. I am attaching the notes from a meeting that took place in 2021 about this property. I notice that on pages 3-4, it mentions that this property could have a SFR on it. We are considering making the exact footprint into a residence that could be used as a transient (short term) rental. Can you confirm that is allowable for this property that has an Assessor's Land Use Code of 5000 - Commercial/Whl/Ret/Inc Restaurants? 2. This property currently has a dock next/attached to it. I have attached the permit for this dock and the Record of Survey. Is this portion of land (and the dock?) exclusive to 252 Orcas Drive? If not, who all has access to this shared easement? 3. Case Number  SDP2007-00016
Description  Shoreline Substantial Development (Secondary Use) Permit and Flood Development Permit for a Bulkhead: This proposal is to reduce the unapproved bulkhead that is in place currently. However, the proposal is an expansion over the legally permitted bulkhead that existed prior to December 2006. The applicant originally applied for a shoreline exemption permit. After an investigative site visit staff determined the project exceeds the threshold for a shoreline exemption permit. This proposal is to reduce the current unapproved bulkhead from 14 ft to 4-ft out from the base. A sinkhole developed near the southeast foundation of the former Oyster House Restaurant and the shore abutment for the pier near the boat ramp for the Trend West Discovery Bay Complex. On February 13, 2007 repair work started without appropriate agency approvals. The new bulkhead could not remain in the footprint of the damaged bulkhead because of soil instability caused by the sinkhole. Projects of this type within a Conservancy Shoreline Designation require a Type III Shoreline Substantial Development permit for a Secondary Use permit with public notice and a public hearing. Other State and local agencies such as the Washington State Dept. of Ecology, Washington Dept. of Fish & Wildlife, Washington Dept. of Natural Resources and Army Corps. Of Engineers have been notified and have had an opportunity to comment on the proposal. A Mitigated Determination of Non-Significance was issued on Tuesday, September 25, 2007. This final determination was issued pursuant to WAC 197-11-355. The SEPA appeal period ended on October 8, 2007. The SEPA Responsible Official did not receive any appeals.
