Case Number  BLD2009-00368
Description  Stormwater Permit with SEPA: The proposal is a 24.7-acre expansion of Miles Sand and Gravel Company's Shine Facility. The expansion is comprised of Reclamation Segments Z1 (10 acres), Z2 (10 acres) and Z3 (4.7 acres). Sand and gravel will be extracted from this new acreage and then conveyed to existing facilities for processing. Native material will be utilized to finish ground slopes in preparation for reclamation. The cut and fill method will be used at this site. Final grades will have a 2.5:1 (40%) average slope at mining boundaries. West Shine Creek, approximately 0.75 miles east and some 200-feet lower than the acreage proposed, flows into Squamish Harbor, which lies approximately 1 mile east of the proposed expansion area. Pheasant Lake is approximately 0.75 miles southwest of the proposed expansion, Mud Lake lies approximately 0.60 miles south of the proposed expansion and Twin Lakes is approximately 0.40 miles west of the proposed expansion. Depending on market demands, mining operators and aggregate truck operators at the Shine Facility, process and haul sand and gravel upwards to 24 hours a day, 7 days per week. Noise is generated by mining and processing equipment (i.e. loaders, bulldozers, rock crushers, wash plants, conveyors and other equipment) and haul trucks. A study of the noise level generated by the Shine Facility operations and received by the neighboring properties was done in October 2002 (Environalysis 2002). A supplemental study was done in 2004 when a new rock crusher was added to the operation (Environalysis 2004). Both studies confirmed that the operations at the Shine Pit (including extraction) do not exceed the Washington State Department of Ecology Noise Standards as adopted by Jefferson County Unified Development Code (UD) during any time of the day, night or weekend. A 48-hour Noise Monitoring study was conducted from June 27-29, 2006 (Environalysis, 2006). This study re-confirmed acceptable noise levels within the pit and therefore, implicitly on Shine and South Point Roads. Moving to this proposed mining area will not create noise not already generated by existing operations. Because of the location and surrounding topography of the proposed mining area, what noise (if any) neighboring properties receive from current mining extraction activities will likely be lowered. Miles is currently working under Department of Ecology (DOE) San and Gravel Permit No. WAG 50-1120. This stormwater report covers a further expansion to Miles' Department of Natural Resources (DNR) Reclamation Permit, as required by DOE. As of May 2000, permit coverage was extended to Ace Paving Company for an asphalt batch plant located adjacent to and subleased from Miles. Ace Paving Company has subsequently received a separate permit, WAG 50-1237. Both Ace Paving and Miles will continue to monitor discharges from the Ace Paving portion of the permitted site. Stormwater generated within the Ace Paving permit area is discharged to process water ponds for the mining operation and is ultimately discharged to the northerly infiltration pond where infiltration to groundwater occurs. Miles monitors all discharges to groundwater that result from mining operations. All Stormwater generated on-site is infiltrated to groundwater per the existing permit. No discharge to surface water is anticipated at this project location. Type 1 Stormwater, generated off-site to the west, is also infiltrated on-site. Type 2 Stormwater from the actively mined portion of the project is infiltrated within the excavation area. Grading in the active mining area prevents stormwater from leaving the site, allowing infiltration for the entire area of exposed soils within the excavation area. Type 2 Stormwater from stockpile areas is intercepted and directed to the infiltration areas. Stormwater quality enhancement treats Type 3 Stormwater from the impervious areas surrounding the operations facilities. A sedimentatio

Case Number  BLD2009-00079
Description  Stormwater Permit with SEPA: Fred Hill Material Inc. (FHM) leases from Pope Resources who owns the 72,000 acre Hood Canal Tree Farm. FHM mineral extraction and processing areas (referred to as the Shine Hub) totals 211.5 acres and is designated a Mineral Resource Overlay District (MRL). The current proposal by FHM is to add 10 acres of additional mineral extraction area (pit area), adjacent to the Shine Hub. These areas would be comprised of two 5-acre segments (X & Y). This would bring the total area to 231.5 acres currently regulated under a DNR Reclamation permit. This area has been logged by Pope Resources through Forest Practice Application (FPA). The additional pit area is located in a Commercial Forest designation, where mining is a permitted activity provided that no more than 10 acres is disturbed at any one time. Disturbed area is defined by RCW 78.44.031(5) and is determined by the WA State Department of Natural Resources through their Reclamation Permit. The current mineral extraction is occurring in Segments V & W where a good deposit of gravel had been located. This area is located behind a berm south of the Shine Hub. The proposed expansion (Segments X & Y) is located south of Segments T & U and west of Segment U (see Reclamation Sequence Map). The extraction would start at the southern boundary of the existing Shine Pit and continue eastward and southward through two reclamation segments of approximately 5 acres each. The mining will utilize the cut-to-grade method. The grade of the mining slopes will "daylight" at the edge of the boundary of the new mining area, without a reclamation setback. The maximum depth of mining within this expansion will be approximately 115 feet. The proposed expansion is for mining (extraction) of aggregate only. The Shine Pit processing and vehicle repair, fueling, and maintenance will be followed including limiting extraction to remain above the seasonal high groundwater. The final floor and finished slopes of the mine will be contoured to vary in elevation and be graded to naturally sweep into adjacent terrain. All finished slopes will vary from 2:1 horizontal to 3:1 horizontal, with an average slope of 2.5:1. Contouring of the slopes will be graded to have a "natural feel" sinuous slopes, free of any "man-made" rectilinear lines. The final floor of the mine adjacent to the higher portions of the slopes will be graded toward the base of the slope, allowing stormwater to infiltrate to groundwater. The floor will be graded with varying heights and cut with interceptor swales (drainage channels). The varying floor heights and swales will curve and flow "naturally" across the final floor topography, not be cut as a straight line "man-made" from one boundary to another. Swales will be cut along the boundaries of the proposed new mining area. The grade of these swales will also be sinuous in nature. The proposed new mining area may have various sand pockets that will not be removed; instead, they will be used to help create a "natural feeling" sinuous final topography. After the area is mined, stored topsoil would be spread over the final mine floor a minimum of 6 inches deep and over finished slopes at a depth of 4-6 inches. Forest debris (i.e. stumps and branches) will be placed over the final floor and finished slopes, providing erosion control, moisture retention, shading and nutrients for future pioneering plants. Re-vegetation will occur during the non-growing season. A native seed mix will be applied in the fall at a rate of 25lbx/acre, consisting of slender wheatgrass (50 percent) sheep fescue (40 percent) and sand dropsied (10 percent). Up to 30 percent white clover may be added to the seed mix. In late winter, healthy, quality stock of Douglas fir seedlings will be planted in the furrows ripped in the floor of the pit. Douglas fir seedlings will be planted on a 10-foot by 10-foot grid with a planting density of approximately 435 per acre

Description  Stormwater w/SEPA: Stormwater Permit with SEPA: Fred Hill Material Inc. These areas would be comprised of two 5-acre segments (V & W). This would bring the total area to 221.5 acres currently regulated under a DNR Reclamation permit. The current mineral extraction is occurring in Segments R, S, T, & U where a good deposit of gravel had been located. This area is located behind a berm south of the Shine Hub. The proposed expansion (Segments V & W) are located north of Segments R, S, T, & U (see Reclamation Sequence Map). The extraction would start at the west boundary of the existing Shine Pit and continue eastward through two reclamation segments of approximately 5 acres each. The mining will utilize the cut-to-grade method. The grade of the mining slopes will "daylight" at the edge of the boundary of the new mining area, without a reclamation setback. The maximum depth of mining within this expansion will be approximately 50 feet. The finished floor of the mine will have a vertical separation of more than 100 feet above the seasonal high groundwater table (see cross sectional map for more details). Final reclamation will be done in a manner to emulate the natural sinuous lopes of the surrounding terrain. The final floor and finished slopes of the mine will be contoured to vary in elevation and be graded to naturally sweep into adjacent terrain. After the area is mined, stored topsoil would be spread over the area, forest debris spread over the area, a cover crop established, and then replanted with Douglas Fir for the subsequent use for timber production. It is anticipated that all of the mineral extraction (segments V & W) south of the Shine Hub would be reclaimed by winter of 2008 (per the Reclamation Sequence Map). The Wahl Extraction area (approved through MLA03-377 on July 18, 2005) is located near Thorndyke Creek and its unnamed Tributary. The applicant has indicated that they are not seeking to mine within the Wahl Extraction Area at the present time because they want to obtain base line surface and groundwater monitoring data before mineral extraction occurs. This will help ensure that the impacts associated with mineral extraction can be separated from the natural hydraulic conditions. Jefferson County has a Stormwater Permit to review and is the lead agency for the environmental review of the proposal under SEPA. Jefferson County is issuing a MDNS for this proposal. The threshold determination for this proposal incorporates the Final Modified MDNS issued for Ace Paving Conditional Use Application (ZON 98-41) within the 144 acre mineral extraction and processing area, which was issued by Jefferson County DCD on June 1, 1999. Documents referenced in this notice are available the Jefferson County DCD during office hours. The applicant will require an amended WA State DNR Reclamation Permit and an amended NPDES General Sand and Gravel permit from the WA State Department of Ecology.

Description  The proposal by Fred Hill Materials Inc. (FHM) is to add 10 acres of additional mineral extraction area (pit area) to the existing 144 mineral extraction and processing area, which currently has a DNR Reclamation permit. The additional pit areas are located in a Commercial Forest designation, where mining is a permitted activity provided that no more than 10 acres is disturbed at any one time. Mineral extraction would not occur within 10 feet of the high seasonal groundwater table. This proposed additional mineral extraction area will provide a source of material for FHM operation until mineral extraction is determined through a permit process within the 690 acre Mineral Resource Overlay District adopted through Ordinance 08-0706-04 on July 6, 2004. The 690 acre MRL area is located approximately 1 mile west of the existing 144 acre mineral extraction and processing area. The current mineral extraction is occurring behind a berm near the eastern edge of the 144 acre mineral extraction and processing area (Segment H - Sheet 2). An approximately 1 acre mineral extraction area is proposed along the eastern edge of the 144 acre mineral extraction and processing area (Segment I). This mining area (Segment I) has an average width of approximately 175 feet (varies 150 to 200 feet). The permit expansion area averages about 90 feet wide (varies 80 to 100 feet). Segment I will include the removal of the berm and increasing the depth of the pit area from 55 to 95 feet to achieve a sinuous grade for the reclaimed surface. It is anticipated that the mining in this area will begin around November, 2004 and will be completed in the spring of 2005, when the entire eastern edge of the pit will be planted in trees for the subsequent use for timber production (Segment I - Sheets 2 & 5). After mining is completed at the eastern edge of the pit area (Segment I), the mineral extraction would be moved to the 9 acres located south and west of the current 144 acre mineral extraction and processing area. This would entail the removal of material to a maximum depth of 35 feet over an area with an average width of 400 feet (Segments J & K - Sheets 2 & 4). Jefferson County has a Stormwater Permit to review and is the lead agency for the environmental review of the proposal under the State Environmental Policy Act (SEPA). The threshold determination for this proposal incorporates by reference the Final Modified MDNS issued for Ace Paving Conditional Use Application (ZON 98-41) within the 144 acre mineral extraction and processing area, which was issued by Jefferson County DCD on June 1, 1999. The Final Modified MDNS for ZON 98-41 (log item 11) is available for review at the Jefferson County DCD office. The applicant will require an amended WA State DNR Reclamation Permit and possibly an amended NPDES General Sand and Gravel permit from the WA State Department of Ecology.

Description  LOCATION: Fred Hill Materials Inc. (FHM) has submitted a proposal on 165 acres referred as the Wahl Extraction Area. The 165 acres in portions of Section 1, Township 27 North, Range 1 West, lying approximately 1.25 miles west of the existing Shine Hub operated by FHM. The permit area includes a proposed 137-acre mining/excavation area, 19 acres identified as regulated critical areas and/or required mining setback areas, and a 60 foot easement from the extraction area to the Shine Hub that would total 9 acres. COMPREHENSIVE PLAN: The 165 acre area is designated Commercial Forest by the Jefferson County Comprehensive Plan. This area is also designated as Mineral Resource Lands Overlay (MRL) by Jefferson County's adoption of Ordinance 08-0706-04 on July 6, 2004, and is subject to 15 conditions of approval governing any activities conducted within the MRL. CASE HISTORY: This proposal was received on July 3, 2003. The case was placed on hold to wait for the issue related to the Comprehensive Plan Amendment (CPA) for a MRL (MLA 02-235) to be resolved. On October 14, 2004 the Western Washington Growth Management Hearings Board determined that the CPA for a MRL was in compliance with SEPA and the Growth Management Act. The application was taken off hold after the Hearing's Board decision. The application was routed on December 23, 2004 to agencies with jurisdiction and interested parties. A Threshold Determination of a Mitigated Determination of Non-Significance (MDNS) was issued on March 30, 2005. Based on comments received regarding impacts to the hydrology to Thorndyke Creek, the SEPA Responsible Official withdrew the MDNS in a Memo dated May 12, 2005. When the threshold determination was withdrawn, this in effect put the proposal at the very first step of SEPA, which is having to issue a Threshold Determination. The May 12, 2005 Memo also indicated that the current proposal would result in probable significant adverse impacts to groundwater movement, quality, and quality, which would result in a Determination of Significance. WAC 197-11-350(2) & (6) indicates that an applicant should be informed that a Determination of Significance is likely and be provided an opportunity to change a proposal to address the issues that consider a Determination of Significance. On June 1, 2005 an on-site meeting was held with DCD, The Port Gamble S'Klallam Tribe, WA State Department of Fish & Wildlife and the applicant to examine issues related to impacts that mining would have on the hydrology of Thorndyke Creek and a unnamed tributary to. Part of the concern expressed was that there was no site specific data that documented the relationship between surface and groundwater to in-stream flows. Also, there was not field documentation on how long it took water to pass through the material found within the Wahl Extraction area. In addition, although the MRL was 500 feet from Thorndyke Creek, mineral extraction was proposed approximately 200 feet within the riparian zone of unnamed tributary to Thorndyke creek. The applicant has modified their proposal to re-sequence the areas to be mined by starting near center of the MRL at the eastern edge instead of the southeastern corner (See Reclamation Sequence Map dated June 17, 2005). This would move the initial mining areas from 200 to 500 feet from the riparian fringe of the unnamed tributary. In addition, and would change the timing of when the area closest to the unnamed tributary from the first to the last area to be mined, contingent on the results from the monitoring data.
