Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: DRAINAGE CONDITION
Wording With this setback reduction, the county is not responsible for preventing runoff from the road to adjacent residential properties. Development of adjoining properties shall not be cause for the County to undertake improvements to alter drainage patterns. The property owner shall accommodate drainage and onsite runoff as part of existing and future development.

Title: APPROVAL CONDITION
Wording This approval is for an administrative road setback variance for an existing road within a mobile park from 20 feet to 5 feet. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and this approval does not preclude conditions that may be placed on future permits.

Title: INCONVENIENCES CONDITION
Wording Road setback reductions may cause inconveniences for land owners in the future if such items as fences, landscaping, or drainage facilities are placed near the easement. Easement work could include installation and maintenance of utilities and ditches or widening of the easement. Under no circumstances shall any development be placed on the road easement. Owner may be financially liable for the cost of removing items near or within the easement and owner accepts all risks.

Title: ONSITE PARKING CONDITION
Wording Reducing the setback to five feet shall not impact the requirement for two onsite parking spaces. The vehicles shall be parked entirely within the designated parking areas on the property and shall not be within the road right-of-way.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-PROPOSAL FINDING
Wording The proposal is to reduce a 20-foot road setback along B Court Lane (within a mobile home park) down to 5 feet so that setbacks required by Jefferson County Environmental Health for septic systems can be met.

Title: F-Confirmed ESAs
Wording The Geographic Information Systems mapping review identified the following Critical Area on the subject property: critical aquifer recharge area (special aquifer recharge protection area). Replacing a mobile on this parcel for single-family residential use does not trigger the requirement for an aquifer recharge report.

Title: F-Site Plan Changes
Wording The site plan, as submitted with the building application on June 22, 2020, has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated August 22, 2020 shall be resubmitted for review and approval by Jefferson County Department of Community Development.
