Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Sign Illumination
Wording The illumination of signs shall be shaded, shielded, or directed so as not to adversely affect surrounding properties or public and private rights-of-way or create a hazard or nuisance to the traveling public, or to surrounding properties.

Title: Sign No Moving Parts
Wording No sign or part thereof shall consist of rotating, revolving, or moving parts; consist of banners, streamers, or spinners; or involve flashing, blinking, or alternating lights.

Title: Sign Square Footage
Wording The total square foot of the sign shall not exceed 69.1 square feet.

Title: Sign Outside Dimensions
Wording Only one side of a double-faced sign shall be counted when determining total square footage. The square footage of the sign shall be calculated by the outside dimensions necessary to frame the information displayed.

Title: Sign Free Standing or Projecting
Wording There shall be no more than two (2) on-premise free standing or projecting signs or combination thereof.

Title: Sign Attached or Painted Against
Wording Signs attached to or painted against the structure to which it relates shall not be computed as part of the overall total square footage or number.

Title: Sign Maintenance
Wording All signs shall be continuously maintained. Signs that present a hazard shall be subject to abatement.

Title: Sign Freestanding & Vehicles
Wording Free-standing signs shall include measures to restrict vehicles from passing beneath them.

Title: Sign Landscaping
Wording Signs shall be incorporated into the landscaping of the site when landscaping is provided.

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-TRAFFIC FLOW SIGNS
Wording The on-site directional signs located on the property which are placed to direct the on-site flow of traffic as a safety measure around the bank and drive-through, and which do not advertise the business location as with directional signs described in 18.30.150(3)(h), do not add to the total allowed square footage of commercial signs on the property. These traffic directional signs do not meet the definition of "Sign" pursuant to 18.30.150(3)(z).

Title: F-APPROVAL FOR > 64 S.F. OF SIGNS
Wording The total square footage of the proposed signs is 69.1 square feet, exceeding the maximum total of 64 square feet for a commercial signs on the subject property. The UDC Administrator finds that the proposed signs are essentially the same as those signs that are being replaced, the larger sign size proposal is consistent with the standards of JCC 18.30.150(1) Purpose of Sign Code, and the proposal qualifies for an increase in total square footage to 69.1 square feet pursuant to JCC 18.30.150(6)(d).

Title: F-NUMBER OF SIGNS
Wording The proposal is for a total of two onsite signs--the tower-mounted sign and the bank facade sign--meeting the requirements of JCC 18.30.150(6)(f) "shall have no more than two on-site signs". Additional directional information on the property do not meet the definition of "Sign' under JCC 18.30.150(2)(z).

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on December 31, 2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Purple Martin, Critical Aquifer Recharge Area + Susceptible Aquifer Recharge Area, Coastal Saltwater Intrusion Protection Zone.

Title: F-Susc. Aquifer Recharge Area
Wording Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers.

Title: F-Critical Aquifer Recharge Area
Wording Critical Aquifer Recharge Areas are defined as Seawater Intrusion Areas, and Special Aquifer Recharge Protection Areas and the following land uses located within Susceptible Aquifer Recharge Areas (1) All Industrial Land Uses (2) All Commercial Uses (3) All Rural Residential Land Uses requiring a Discretionary Use or Conditional Use Permit (4) All Rural Residential Land Uses with nonconforming uses that would otherwise require a Discretionary Use or Conditional Use Permit (5) Unsewered Planned Rural Residential Developments (6) Unsewered residential development with gross densities greater than one unit per acre. All of the above listed uses shall be subject to the applicable requirements and standards of the Jefferson County Unified Development Code.

Title: F-Coastal SIPZ
Wording The parcel is located within a coastal SIPZ (seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy (Resolution 61-02, effective September 23, 2002) that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet.

Title: F-SEPA Exempt
Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(2)(c): "The construction and/or installation of commercial on-premises signs".

Title: F-Site Plan Changes
Wording The revised site plan as submitted with the Replacement of Two On-Site Commercial Signs application on December 15, 2015 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated January 11, 2016 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for Replacement of Two On-Site Commercial Signs only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: ZONING
Wording The parcel has been designated as UGA Urban Commercial/Rural Village Center Transitional Zoning under the Jefferson County Comprehensive Land Use Map effective August 28, 1998 and as amended.

Title: F-General PMT Notice
Wording NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that "takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat" for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: - All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees - Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet (1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service.
