Description:Finnriver Cidery is proposing a phased project over the next 2-5 years to include organic apple orchards, new production facility, tasting room, office space, commercial kitchen and special event space on the historic 50 acre Brown Dairy Farm. Phase 1 includes renovation to the Farm House in anticipation for use as office space for non-profits, demolition of old barns and site clean-up. Phase 2 is a temporary interim step to relieve traffic at their current site by making the subject property available for weekend events to include adequate parking, shelter, courtyard, mobile food service and commercial kitchen. Phase 3 will include a new indoor tasting room and event space. The fourth and final phase will be the construction of the new cider production facility. This project requires a Type II Discretionary “D” Use Permit with SEPA review under JCC 18.22.030, and development and performance standards under JCC 18.20.350 and JCC 18.30, with public notice and public hearing only at the discretion of the UDC Administrator under JCC 18.15.040(2). Title: SUBSEQUENT PERMITS
Wording This project requires addtional building and septic permit approval for future development of the production facility, tasting room, pavilion, commercial kitchen, parking, landscaping and septic systems. Additional review for code consistency will occur as part of the building permit review and approval process.

Title: STORMWATER
Wording Land disturbing activity in excess of 7,000 square feet and creation of imperious surface in excess of 2,000 square feet requires County review and approval either through an associated building permit or stand-alone stormwater management permit. This would apply to proposed parking areas as well as hard surfaces such as rooftops.

Title: ON SITE AG WELL
Wording The on-site well identified as "Existing Ag Well" on the approved site plan will require submittal of additional information regarding the well, depth, when dug and diameter, together with adequate mitigation for the potential sources of contamination being located immediately adjacent to the well head, prior to approval of construction of the adjacent parking lot.

Title: NPDES
Wording The project includes clearing, grading and/or excavation that result in the disturbance of more than one acre. If there is discharge of stormwater to surface waters of the State (as defined by the Department of Ecology) the proponent will likely be required by the DOE to apply for a NPDES Construction Stormwater General Permit (CSWGP). You may apply online or obtain an application from Ecology's website at: http://www.ecy.wa.gov/programs/wq/stormwater/construction/ - Application. Construction site operators must apply for a permit at least 60 days prior to discharging

Title: ROAD APPROACH PERMIT
Wording The Center Road approaches have not been reviewed nor permitted by Public Works. The Applicant shall apply for a Public Works Road Approach Permit for permanent access to Center Road. The approaches will need to meet the standards for the intended use of the property, which will be determined at the time of review. Review of the Road Approach Permit is separate from Public Works Stormwater review. Application for the Road Approach Permit does not guarantee approval, which is required prior to subsequent building permit approval.

Title: LANDSCAPING
Wording Ten feet of Screen "C" landscaping (a “see-through screen” that functions as a partial visual separator to soften the appearance of parking areas and building elevations, and shall at a minimum consist of a mix of evergreen and deciduous trees or shrubs generally interspersed to create a continuous canopy.) shall be installed along the entire Center Road frontage. A detailed landscaping planting plan shall be required prior to review and approval of parking areas or subsequent building permits.

Title: OPEN SPACE AG PROGRAM
Wording The property, with the exception of a one-acre homesite, is currently assessed under the Current Use/Open Space Agricultural program. Any changes to the property that will not allow this continued use will result in that portion of property removed from the classification and compensating tax paid. Title: POTENTIAL CONTAMINATION
Wording The proposed project is next to Bill’s Garage which is a state cleanup site (Cleanup Site ID 5941), due to underground storage tanks that leaked. If contamination is suspected, discovered, or occurs during the proposed SEPA action, testing of the potentially contaminated area must be conducted. If contamination of soil or groundwater is readily apparent, or is revealed by testing, Ecology must be notified. Contact the Environmental Report Tracking System Coordinator in the Southwest Regional Office (SWRO) at (360) 407-6300. For assistance and information about subsequent cleanup and to identify the type of testing that will be required, contact Joyce Mercuri with the SWRO, Toxic Cleanup Program at the phone number given above.

Title: WATER RIGHTS
Wording Any water rights associated with previous agricultural activity on the project site are subject to relinquishment if they have not been exercised for five (5) years without sufficient cause. Any modification of existing water rights must be approved by Ecology’s Water Resources Program.

Title: WSDOT
Wording The Applicant shall contact WSDOT regarding applicable SR19 road approach and access permit requirements.

Title: FOOD SERVICE
Wording Food service requires permits from the Environmental Health Department and is limited to no greater than 5,000 square feet of indoor space with seating not to exceed 50. Drive-thru service is prohibited. The capacity of outdoor events with food service is limited to the available on-site parking, and requires appropriate permitting from the Environmental Health Department.

Title: OUTDOOR EVENTS
Wording Outdoor events must be related to agricultural activities on-site and capacity is limited to available on-site parking as depicted on the approved site plan dated July 13, 2015. Events on site that exceed the available on-site parking, cause parking along the road right of way or disrupt the the peaceful enjoyment of neighboring properties is prohibited and may invalidate permit approval.

Title: NOISE
Wording Sound that originates from the subject property that exceeds the noise levels permitted under WAC 173-60, or that otherwise do not comply with Jefferson Noise Control Ordinance No. 02-0209-15, may be a violation and subject to penalities.

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: F-Site Plan Changes
Wording The site plan as submitted for the Zoning Discretionary "D" Use Permit application on June 1, 2015 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 13, 2015 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Wording This approval is for a Discretionary "D" Use permit to allow phased development of the subject site as outlined in the project description as a "yes" use only.
