Description:Phased development for a private, non-profit pre-kindergarten and elementary school and educational facility. Phase I of the proposal is to place modular structures as elementary school classrooms for school year 2006/2007. Additional phases include constructing the permanent elementary school building and early childhood development center, administrative offices, great hall, educational overnight farm-stay facility, commercial kitchen, dining hall, processing plant to support farm-stay facility and to support processing of farm products, and related amenities for the farm-stay facility, farm worker housing, additional workshop facilities, retail spaces, and expansion of existing agricultural structures. The proposed development is sited on an 81-acre parcel of which 76 acres is in conservation easement recorded under AFN 497024. All development will be located within the 5-acre area outside the conservation easement. The Administrator has identified this development as a permitted use pursuant to Jefferson County Code (JCC) Chapter 18.20.030. JCC Chapter 18.20.30(3)(e)(i) states a permit process is required when the proposal exceeds terms or limitations of exempt accessory agricultural uses. Those permits are considered discretionary uses (i.e. "D" uses) as defined at JCC Chapter 18.15.020(1)(b). On the basis of Administrative review, the Administrator may classify the proposed "D" use as either an allowed use, a prohibited use, or a conditional use in the particular land use district. It is the Administrator's determination that this proposal is subject to a Type III Condition Use Permit. The proposal is subject to the State Environmental Policy Act (SEPA) review. The optional DNS process of WAC 197-11-355 is being used. This notice includes the Final Threshold Determination that a Mitigated Determination of Non-Significance (MDNS) has been issue. A Mitigated Determination of Non-Significance was issued May 31, 2006. This final determination is issued pursuant to WAC 197-11-355(4)(a). Jefferson County has considered timely comments on the notice of application and determined to modify the threshold determination of nonsignificance to a MDNS. There is no additional comment period. Parties of record can appeal the Final Threshold Determination by 4 p.m. on June 14, 2006. The specifications for appeals are outlined by Chapter 18.40.360 (5) JCC, and require a $647 appeal fee. Wording Prior to construction of the access road, driveways, and parking areas, the proponent shall provide to the Department of Public Works a detailed site development plan that depicts the SR 19 (Rhody Drive) access, access road, driveways, parking areas, striping, and traffic control signs. The plans shall be reviewed and approved by the Department of Public Works prior to construction. The plans shall include a typical section for the access road, including pedestrian and drainage facilities.

Wording In order to meet the requirements of the Washington Department of Ecology Stormwater Management Manual for Western Washington and to ensure that the approved stormwater management facilities are appropriately maintained for the life of the project, Jefferson County requires the proponent to enter into a Stormwater Management Facility Maintenance Agreement with the County. After construction has been completed, Department of Public Works will send the proponent a copy of the Agreement that has been signed by the Public Works Director. Department of Public Works cannot give final approval for the project until the Agreement has been signed by the proponent and filed with the Jefferson County Auditor.

Wording After construction is complete, the proponent shall submit a letter from the project engineer certifying that the stormwater management facilities have been constructed as per the approved plans. The Department of Public Works cannot give final approval for the project until this certification has been received.

Wording Proponent shall continue exploring the possibility of starting a vanpool service with Jefferson Transit. A written agreement shall be submitted to Department of Community Development. Wording To provide ADA Paratransit service, Jefferson Transit will need to enter the school grounds. Paratransit service delivery requires a roadway and loadzone that allows for the safe maneuvering to the curb of a van up to 25 feet in length. Wording A copy of the agreement with the adjacent business (currently Fiesta Jalisco Mexican restaurant) shall be submitted and approved by Department of Community Development, Department of Public Works and WSDOT. It is understood that some of the parking and loading functions of the restaurant will remain on the access easement. The agreement shall adequately accommodate the above without posing any safety concerns to the school. This agreement shall acknowledge and confirm that the terms and conditions of the agreement "touch upon the land" and shall "run with the land" or any part thereof described in this agreement for perpetuity. This agreement shall be recorded with Jefferson County Auditor's office upon review and obtain approval by the above referenced departments.

Wording In accordance with the Jefferson County Coordinated Water System Plan, the proponent is required to connect to the existing PUD water system. Potable water shall be provided consistent with local, state and federal requirements.

Wording Jefferson County Environmental Health Department has stated that review of the soils report and site inspection by the Environmental Health Department indicates that soils are suitable for the use of onsite sewage systems. The system shall meet the onsite sewage codes in place at the time of application for a permit.

Wording The entire parcel is within a Special Aquifer Recharge Protection Area and Susceptible Aquifer Recharge Area. In compliance with Jefferson County Code Title 18.15.255(3), applicant shall work closely with a Washington State Licensed Septic Designer and Jefferson County Department of Environmental Health to identify minimum land area and best management practices for nitrogen removal as design parameters necessary for the protection of public health and groundwater quality. Applicants shall work with a Washington State licensed septic designer and Environmental Health Department on the onsite sewage system design and meet applicable code standards.

Wording Though it is exempt from development review under Title 18.20.030 JCC, should a composting facility being proposed on the parcel, the proponent shall contact Environmental Health staff Mark Nelson at (360) 379-4489 to determine if a composting permit is required.

Wording This conditional use permit shall expire and become void if the applicant fails to file for all building permits for all phases or other necessary development permits within five years of the effective date of the decision granting the conditional use permit.

The exemption covers only existing and ongoing activities related to cultivating crops and grazing livestock and the land preparation associated with those agricultural activities. The exemption does not cover new structures, parking areas, or other similar development activities. These development activities shall comply with applicable setback and buffer requirements and obtain proper permitting.

Wording The agricultural communities in each Jefferson County watershed are expected to establish and implement appropriate agricultural best management practices (BMPs) in order to protect wetlands and fish and wildlife habitat areas from adverse impacts related to the practice of agriculture.

Wording Agricultural activities shall be conducted in a manner that protects against harm or degradation to the existing functions and values of fish and wildlife habitat in and adjacent to streams and wetlands through the implementation of agricultural best management practices (BMPs).

Wording BMPs shall be designed for site-specific conditions and should include pollution prevention and control measures that effectively address the following management areas: a. Livestock and Dairy Management. Livestock and dairy operations must be conducted so as not to contribute any wastes or sediments into a natural or modified natural stream in violation of adopted state water quality standards. b. Nutrient and Farm Chemical Management. Manure must not be placed in a stream or location where such wastes are likely to be carried into a stream by any means. Farm chemicals shall be applied consistent with all requirements stated on the chemical container labels and all applicable federal and state laws and regulations, such as Chapter 15.58 RCW (Pesticide Control Act), Chapter 17.21 RCW (Pesticide Application Act), and 7 United States Code (USC) 136, et seq., (Federal Insecticide, Fungicide, and Rodenticide Act). c. Soil Erosion and Sediment Control Management. Construction of roads used for agricultural purposes, agricultural equipment operation, and ditch construction and maintenance should be undertaken in such a manner as to avoid sediment contribution to streams. d. Operation and Maintenance of Agricultural Drainage Infrastructure. Dredging or removal of accumulated sediments in any ditch or ditched stream should be conducted when there is no or minimal flow in the stream (generally between June 15th and October 31st) and in a manner that minimizes sediment contribution or other impacts to water quality. Excavation spoils should be placed so as not to cause bank failures and so that drainage from such spoils does not contribute sediment to streams. Maintenance of vegetation located within a stream that is part of drainage infrastructure may be conducted at any time; provided, that any cutting or mowing is above the ground surface within the channel and in a manner that does not disturb the soil or sediments and that the cut vegetation does not block water flow. Stream bank vegetation should be preserved or planted as soon as practicable after drainage construction and maintenance are completed in order to stabilize earthen ditch banks. e. Riparian Management. Existing riparian vegetation should be managed to continue to provide soil and streambank stability, shade, filtration, and habitat for fish and wildlife. Landowners are encouraged to plant riparian vegetation to improve fish and wildlife habitat by providing shade, cover, organic debris, and control of noxious weeds.

Wording Jefferson County, the Jefferson County Conservation District, and the Department of Ecology shall work cooperatively to identify potential violations of state water quality standards and to provide assistance to agricultural owners and operators for preventing or correcting water quality violations. The Department of Ecology maintains ultimate compliance authority for enforcing state water quality standards.

Wording Agricultural buildings that contain plumbing other than that as authorized above shall obtain a plumbing installation permit and Health Department approval.

Wording Parking areas that have five (5) or more parking stalls shall comply with the following: a. Screening shall be provided on each side, front, and/or rear of a parking lot where such side, front, and/or rear abuts any residential use or district, except that no screening is required where the elevation of the parking area lot line is four feet higher than the finished elevation of the parking surface. b. Parking lot screening and landscaping shall be kept in good condition and shall meet the following conditions: (i) It shall be continuous where required along a side, front or rear of a parking area and shall not be less than four (4) feet in height above the grade of the parking lot surface, broken only for accessways and aisles, provided that the screening shall not be permitted for a distance of twenty (20) feet on each side of a parking area accessway to ensure proper sight distance. Where screening is prohibited by the above provisions, low-lying shrubs or other similar plantings shall be placed: such plantings shall not be allowed to exceed three (3) feet in height. (ii) Screening shall not be installed in such a manner as to obstruct the free use of any fire hydrant(s). (iii) The space between the landscaping screen and the right-of-way, except for any pedestrian access improvements, shall be landscaped with grass, shrubs, trees, or evergreen groundcover. On the sides and rear of parking areas not facing a street such landscaping shall be required between screening and the lot line.
