Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: PURPOSE PLAT ALTERATION
Wording The proposed plat alteration is to convert the "common area" into a residential lot. Irondale county park abuts the western boundary and thus will provide a larger area for recreation for the lot owners within the Tamarack Village Subdivision. At time of recording of the Tamarack Subdivision, the plat identifies dedicated 10 foot wide walkway easements to the park.

Title: CRITERIA
Wording The proposed plat alteration conforms to all applicable county, state and federal land use, environmental and health regulations and plans, including but not limited to the Jefferson County Comprehensive Plan and the provisions of the Unified Development Code.

Title: CRITERIA
Wording The lot has been determined by the Environmental Health department that the soils on site are suitable to maintain a septic system. PUD #1 will provide water to the parcel. The parcel abuts Patison Street and will have direct access off the street. The parcel is within the Chimacum Scool District 49 and school policy is that students would utilize the bus system to and from the schools as it is to far to walk. Jefferson Transit provides bus service to this area. Open space is provide by the Jefferson County Irondale Park which abuts the western boundary of Tamarack Village subdivision. This park provides greater opportunity for recreation as opposed to this lot being left as open space due to the park having a basketball court and softball fields.

Title: CRITERIA
Wording Probable significant adverse environmetnal impacts of the proposed plat alteration have been considered and determined that the alteration will not result in an unacceptable adverse effect upon the quality of the environment.

Title: CRITERIA
Wording Approval of the proposed plat alteration will serve the public use and interest and provide adquate provision for maintaining the public health, safety, and general welfare.

Title: NOTICE CRITERIA
Wording The Department of Community Development sent notice to all owners of lots within the plat of Tamarack Village Subdivision advising them of the proposed plat amendment. The notice was mialed on January 15, 2003. One lot owner submitted a written comment stating that he perfered that the lot be left as "common area".

Title: HEARING NOTICE
Wording None of the notified lot owners within the Tamarack Village Subdivision requested a public hearing regaring this plat alteration application. Consequently, no notice of public hearing has been given.

Title: LOT DENSITY
Wording The parcel is a legal non-conforming lot that is desaignated as RR 1:5 under the Jefferson County Comprehensive Land Use Map effective August 18, 1998.

Title: CC & R'S
Wording Restrictive Conditions and Covenants were recorded under AFN 261191 on October 9, 1979. The CC & R's were amended under AFN 267185 August 19, 1980. Furthermore, the CC & R's were amended under AFN 382954 on July 7, 1995 which deleted paragraphs 11 & 12 under AFN 267185. This amendment deleted the Owners Association and the common areas identified as "common area", "planting easement", "utility easement", and "walking easement". At time of said amendment to delete paragraphs 11 & 12, 90 percent of the lot owners signed and had notorized the amendment that was recorded under AFN 382954 on July 7, 1995.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on January 4, 2003 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: SAPA aquifer recharge area.

Title: F-Aquifer Recharge Area
Wording Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County.

Title: F-Susc. Aquifer Recharge Area
Wording Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers.

Title: F-SEPA Exempt
Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(6)(a).

Title: F-Approval for _____ Only
Wording This approval is for a plat alteration on the "common area" of Tamarack Village Subdivision only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.
