Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Other Work/Separate Approval
Wording Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department.

Title: MONITORING
Wording The applicant shall monitor annually and add new, clean cultch as needed to the site to maintain the target density, replacing shell that was moved out of the project area by wave action or that settled too deep in the mud for larvae to settle on. The “construction” method for adding this additional shell is as follows: On a high tide just prior to shell placement, a small, temporary screw anchor and marker buoy will be installed. Shell in bags will be transported by small boat/scow to the target area at high tide at the buoy. On the following daylight low tide, shell bags will be opened, and the shell material spread by hand within the project area in patches where shell is below target density. The marker buoy will be removed. The applicant shall continue to maintain a 25-foot buffer between shell placement and eelgrass (Zostera marina) if and where present within the project area. Monitoring for recruitment, survival and growth will continue annually each summer.

Title: MINIMIZE IMPACTS
Wording Avoidance measures include careful placement of shell to avoid any increase of suspended sediments and turbidity; careful sourcing of clean shell material (free from pathogens and invasive species); and observation of appropriate work-windows (USACE-TRA10/WDFW July 16-Aug 31) to protect listed species. If eelgrass is found within the project area, the project design minimizes impacts to eelgrass by including a 25-foot buffer between eelgrass (indicated by 3 turions/m2) and the areas in which shell is placed. This minimizes foot traffic impacts to eelgrass during the shell distribution process, monitoring, or other activities. Monitoring transects will be recorded using GPS, using the powerline poles as visual reference. No permanent markers will be placed in the project area.

Title: ELLGRASS
Wording The Jefferson County Marine Resources Committee will continue to comply with regulatory eelgrass avoidance requirements and maintain a 25-foot buffer while conducting the proposed activity of spreading clean cultch on bare substrate. The applicant shall only place clean cultch in areas that would not disturb the eelgrass.

Title: Hydraulic Code/HPA Check
Wording Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state.

Title: Comply with HPA
Wording In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-PROJECT SUMMARY
Wording The goal of this project is to continue to enhance Olympia Oyster habitat in Discovery Bay by providing suitable substrate (i.e., clean shell) for Olympia oyster larvae that are naturally dispersing from the nearby extant population to settle on. This in turn improves ecosystem conditions for other marine species that migrate through or live, feed, and seek shelter in native shellfish beds. The Discovery Bay Olympia oyster population is 1 of 19 priority sites identified in the Washington State’s WDFW Olympia Oyster Restoration Plan (2012). No Olympia oyster harvesting is planned as part of this project.

Title: F-PROJECT PURPOSE
Wording Native oyster beds create complex, three-dimensional habitat for invertebrates and small fishes, and foraging locations for larger animals. Filter-feeding bivalves such as Olympia oysters feed on phytoplankton by filtering large volumes of water thereby improving water quality, removing pollutants and nutrients from the water column, and maintaining the water clarity necessary for eelgrass and kelp growth. Restoration and enhancement of this foundation species provides benefits to the marine ecosystem. The purpose of this project is to improve function and viability of the Discovery Bay Olympia oyster population by increasing suitable substrate near the current extant population. The Jefferson County Marine Resources Committee (JCMRC) has a history of working with local partners to protect this population and promote its recovery. One of the limiting factors identified in the WDFW Olympia Oyster Restoration Plan (2012) is lack of suitable substrate. Based on conversations with Brady Blake from WDFW, Puget Sound Restoration Fund staff, and local shellfish experts, JCMRC is focusing on continuing to enhance habitat structure, which will set the stage for this population to eventually expand on its own. JCMRC is proposing to include the new parcel located just SW and adjacent to the currently authorized project site (DNR ROE #23-097627) to expand Olympia oyster habit enhancement efforts here. Access to this new parcel will also enable JCMRC to better monitor and assess habitat enhancement efforts, as previously spread cultch and settled Olympia oysters continue to drift here from the currently authorized project site due to the currents and wave action.

Title: F-SOURCE MATERIAL
Wording The applicant will purchase certified, clean cultch (shell) from Taylor Shellfish, with WDFW transfer permits. Bags of clean cultch will be delivered to an upland staging area, transferred by skiff to the site at high tide and then distributed manually. Shells will be randomly scattered. All shell placement will be between +1 and a -1 tide elevation. We plan to scatter additional shell in subsequent years (through 2023) as needed to maintain scattered shell substrate at the surface. The JCMRC was authorized to place a rough estimate of 20 cu yds each year over a 5-year period (total 100 cu yds) between Sep 2018 and Sep 2023 . Since Sep 2018, the JCMRC has placed a total of 13 cu yds at the Powerlines site (as of Dec 2021). With potential additional funding, the JCMRC intends to place up to130 cu yds total of clean shell (an additional 117 cu yds) at the Powerlines site (including the proposed expansion site) through Sep 2023. We do not consider this a multiple phased project, as it repeats the same action at the same location until the habitat has stabilized.

Title: F-EXPANSION SITE
Wording For the proposed site expansion, the new parcel (located adjacent and SW of the currently authorized site near the powerlines) is in partially-vegetated marine tidelands and bedlands with tidal elevation between approximately +2.0’ and 0.0’ MLLW. The substrate in the project area is primarily sand-mud, surrounded by areas of very soft mud. Tidal channels run along either side of the project area. Marine vegetation, when present, is primarily Ulva spp. and Gracilariopsis. There is a dense eelgrass bed (green in attached map) located north, outside of the proposed shell placement areas (orange in attached map). See attached maps and eelgrass summary report with photos taken on September 20, 2021.

Title: F-Confirmed ESAs
Wording The Geographic Information Systems mapping review identified [and/or a site inspection confirmed] the following Critical Areas on the subject property: Natural Shoreline Designation; FEMA Flood Zone A.

Title: F-SEPA Exempt
Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(24)(j) Establishment of natural area preserves to be used for scientific research and education and for the protection of rare flora and fauna, under the procedures of chapter 79.70 RCW.

Title: F-Site Plan Changes
Wording The site plan as submitted with the Shoreline Exemption application on December 13, 2021 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated February 3, 2022 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for a Shoreline Exemption #16 to Expand Existing Oyster Habitat Restoration Area only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Shoreline Master Program 18.25.560(1) & (16)(c) and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
