The Geographic Information Systems mapping review identified the following Critical Areas on the subject property: geologically hazardous areas (unstable and intermediate shoreline slope stability); fish and wildlife habitat conservation areas (maine water serves as a primary association for list marine species); frequently flooded area; critical aquifer recharge area (CARA, special aquifer recharge protection area plus unknown); seawater intrusion protection zone (SIPZ, coastal).
Critical area reports are not required for maintenance and repair shoreline exemptions so no geotechnical report or habitat management plan was requested. Shorelines mapped as a CARA or a SIPZ do not trigger submittal of a special report.
The applicants submitted a Biological Assessment prepared by Moffatt & Nichol (dated December 24, 2019) to addressfederally-listed species. This proposal requires a federal permitfrom U.S. Army Corps of Engineers (Corps) and the proposal is reviewed at the federal level for compliance wit the Endangered Species Act. Therefore, compliance with the Federal Emergency Management Agency (FEMA) Biological Opinion (BiOp) will be reviewed as part of federal permitting and the applicant is required to comply with the permit issued by the Corps.
