Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-SHORELINE FINDING
Wording Jefferson County Marine Resources Committee wants to continue habitat enhancement activities in Discovery Bay, within an area designated as priority aquatic. The proposal is to maintain and enhance habitat conditions for Olympia oyster larvae in Discovery Bay.

Title: F-CRITICAL AREAS FINDING
Wording The Shoreline Master Program incorporates the critical areas by reference. Discovery Bay is both a fish and wildlife habitat conservation area and a frequently flooded area. For fish and wildlife habitat conservation areas, the proposal meets JCC 18.22.070(21), and is therefore, exempt from critical areas regulatory requirements. For frequently flooded areas, the proposal meets the requirements of the flood damage prevention ordinance and meets section 7.2 of the Model Washington NFIP-ESA Ordinance, and is therefore, exempt from the requirement to submit a Habitat Assessment. The Joint Aquatic Resources Permit Application form states that the applicants will be obtaining a permit from the U.S. Army Corps of Engineers, which will ensure compliance with the biological opinion.

Title: F-DNS Issued
Wording This proposal was previously reviewed under the State Environmental Policy Act (SEPA) by Jefferson County acting as lead agency. A Determination of Non-Significance (DNS) has been issued for previously permitted enhancement work within the project area. The submittal indicates that the current proposal will not expand beyond what has previously been reviewed under SEPA.

Title: F-Site Plan Changes
Wording The site plan, as submitted with the shoreline application on June 5, 2019, has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 10, 2019 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for a clean shells for restoration only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Chapter 18.25 of the Shoreline Master Program and is consequently exempt from the substantial development permit requirements under JCC 18.25.560(18).
