Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: C-BUOY CONDITIONS
Wording Conditions of Approval A. Mooring buoys should not be located where their use will cause the degradation of sensitive ecological areas such as estuaries, wetlands, or aquaculture resources or facilities. Therefore, if through the review of the HPA by WDFW it is determined by the WA State Dept. of Health that this buoy would result in a concentration of boats that would close a shellfish area, the applicant shall not be authorize to place the buoy at this location through this permit. (Policy 6 of Section 5.130 of SMMP). B. Preference for the placement of near shore mooring buoys should be given to the adjacent shoreline property owner. If it is determined that the location of the proposed mooring buoy interferes with a proposal for a mooring buoy by the adjacent landowners, the mooring buoy of the non-adjacent shall be located further away from the shore in compliance with all rules and regulations. (Policy 8 of Section 5.130 of SMMP). C. This proposal does not include land based retrieval lines. (Performance Standard 1 of Section 5.130 of SMMP). D. The installation of the proposed mooring buoys shall not significantly interfere with navigation If it is determined that the proposed mooring buoy interferes with navigation it shall be removed or moved to a location that complies with all rules and regulations. (Performance Standard 2 of Section 5.130 of SMMP). E. Mooring buoys shall be located as close to the shore as feasible. They shall not be located farther waterward than adjacent mooring buoys unless the draft and/or swing path of the boat dictates it. (Performance Standard 3 of Section 5.130 of SMMP). F. Buoys shall be discernible under normal daylight conditions at a minimum of 100 yards. (Performance Standard 4 of Section 5.130 of SMMP). G. Mooring buoys shall be located no closer than 100 feet from another mooring buoy, dock, pier, float, or other fixed navigational obstruction, unless there is a written agreement with the parties affected, including the subtidal property owner, that will allow for said encroachment. If it is determined that the proposed mooring buoy interferes legally established buoys, moored boats, or private tidelands it shall be removed or moved to a location that complies with all rules and regulations. (Performance Standard 5 of Section 5.130 of SMMP). H. The buoys shall be marked with the owner's name, address, and telephone number. (Performance Standard 6 of Section 5.130 of SMMP). I. The buoy shall be designed to withstand the maximum expected physical stress that the environment and moored craft will place on the buoy. (Performance Standard 7 of Section 5.130 of SMMP). J. No more than two (2) boats shall be secured by a mooring buoy. (Performance Standard 9 of Section 5.130 of SMMP). K. Mooring buoys that are placed by exemption shall not be rented or leased. (Performance Standard 10 of Section 5.130 of SMMP). L. Boats that are occupied shall not be permitted to moor at private docks, piers, and floats longer than three (3) days unless pump-out facilities are available in the immediate vicinity. (Performance Standard 1 of Section 5.60 (Docks, Piers & Floats) of SMMP). M. During the installation of the mooring buoy, the location of the mooring buoy may be adjusted to minimize impacts to sensitive habitat areas (i.e. eelgrass beds), provided that revised location complies with all rules and regulations. If the location of the mooring buoy is significantly modified, an amended site map with the amended longitude and latitude shall be submitted to DCD. N. This permit constitutes permission to place a mooring buoy and ground tackle only. Permission to place floats (such as a swim platform) is not authorized. O. No fill or other material may be placed in the waters or intertidal areas of Jefferson County. P. Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review f

Title: Hydraulic Code/HPA Check
Wording Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state.

Title: Comply with HPA
Wording In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval.

Title: Army Corps Check
Wording Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers (COE) in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands. Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-SMMP BUOY
Wording A Joint Aquatic Resources Permit Application has been submitted. This mooring buoy would be located outside of private tidelands in water 24 feet deep at a zero tide. Issues related to the availability of existing docks, moorage facilities, and public mooring buoys were addressed in this review. The issues the mooring buoys are preferred over private docks and that preference should be giving to upland landowners was considered in this review. This proposal is for mooring buoy with a helix anchor screw system with mid line floats synthetic line that will not scrape or damage bottom. The required HPA can ensure that during the installation of the mooring buoy that it will not be placed in sensitive habitat areas (i.e. eelgrass beds). This type of anchoring system provides strength while minimizing impacts to the shoreline vegetation and marine organisms. Based on the design of proposed mooring buoy and with the recommended conditions of approval, this proposal has been determined to be in compliance policies and performance standards for Mooring Buoys (Section 5.130) and other requirements of the SMMP. This proposal will require a Hydraulic Project Approval (HPA) from the WA State Department of Fish and Wildlife and may require an Aquatics Lease from the Washington Dept. of Natural Resources and review by the U.S. Army Corp of Engineers if it interferes with navigation.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on 4/21/05 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: marine habitat.

Title: F-SEPA Exempt
Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(25)(g).

Title: F-Site Plan Changes
Wording The site plan as submitted with the Shoreline exemption application (SDP 05-07) on March 3, 2005 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated April 21, 2005 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for the installation of a mooring buoy only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording This proposal has been determined to be exempt from a substantial development permit under Section 3.402(1) & (11) of the SMMP. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
