Title: Notification Prior to Beginning
Wording The proponent shall notify the Jefferson County Department of Community Development at (360) 379-4450 forty-eight (48) hours prior to commencing construction in order to allow monitoring and ensure compliance with permit conditions.

Title: Other Work/Separate Approval
Wording Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department.

Title: No Fill or Other Material
Wording No fill or other material may be placed in the waters or intertidal areas of Jefferson County.

Title: FORM RAAC
Wording A Recreational Advisory Committee (RAAC) shall be created to evaluate an appropriate design and location for a pedestrian trail that spans from the WDFW parking area to the mouth of Chimacum Creek. The RAAC shall be comprised of the Jefferson County Parks and Recreation Advisory Committee, North Olympic Salmon Coalition, WDFW, and citizens at large. The RAAC shall provide a recommendation by August 2, 2006.

Title: FUTURE DEVELOPMENT
Wording When the RAAC recommendation includes proposed development, permits shall be obtained and construction of the trail shall commence within one (1) year following the date of the RAAC recommendation.

Title: INVENTORY
Wording WDFW shall prepare an inventory of parcels along the riparian corridor currently under WDFW ownership. WDFW shall take all reasonable steps to sell as surplus any parcels not directly utilized for restoration projects.

Title: COMPLY WITH STORMWATER
Wording The applicant shall adhere to all of the stormwater information submitted with the proposal.

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: Hydraulic Code/HPA Check
Wording Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state.

Title: Comply with HPA
Wording In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval.

Title: Army Corps Check

Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-ESTUARY PROPOSAL
Wording This proposal is to establish an estuary by removing existing rip rap, vacated road, establishing a new grade for the beach and planting native plants along the shoreline. In addition, the proposal will install a barrier to deter vehicular access. The existing dilapidated road has been vacated through the public hearing process. In addition, Resolution 54-03 was adopted by the Board of County Commissioners.

Title: F-PUBLIC ACCESS
Wording The proposal will continue to allow for public access across the parcel. However, the road will be removed as approved through the road vacation process, which was heard on July 15, 2003. The Jefferson Board of County Commissioners adopted resolution 54-03 relating to the road vacation.

Title: F-BOCC RESOLUTION42-04
Wording The Jefferson County Board of Commissioners passed a resolution (No. 42-04) allowing the restoration proposal to be processed as a shoreline exemption permit pursuant to Section 3.402(19) of the Jefferson County Shoreline Master Program. The resolution included three (3) seperate conditions, which have been added to this permit.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on 6/24/04 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Seismic Hazard, Shoreline (Urban), Landslide Hazard Area I/II, Aquifer Recharge Area, and Coastal Seawater Intrusion Protection Zone (SIPZ).

Title: F-Special Report Submitted
Wording The applicant has submitted a special report conducted by Coast & Harbor Engineering. The report investigated the stability of the bluff and engineering for the proposed restoration project.

Title: F-Aquifer Recharge Area
Wording Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County.

Title: F-Susc. Aquifer Recharge Area
Wording Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers.

Title: F-Coastal SIPZ
Wording The parcel is located within a coastal SIPZ (seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy (Resolution 44-22, effective September 23, 2002) that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet.

Title: F-Stormwater
Wording The applicant is proposing a restoration proposal which will excavate approximately 65,000-cubic yards of material. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal to adhere to the DOE Stormwater Manual (2001 Edition). The applicant has submitted detailed drawings outlining the construction of a swale to convey stormwater near the informal parking area.

Title: F-HPA Issued
Wording The Washington Department of Fish and Wildlife issued Hydraulic Project Approval (HPA) for this activity on June 8, 2004 under Log Number ST-G2906-01. The HPA expires on October 15, 2004.

Title: F-DNS Issued
Wording Reviewed under the State Environmental Policy Act (SEPA) by WDFW acting as lead agency. The original notice was amended and a revised Determination of Non-Significance (DNS) was issued on April 3, 2004.

Title: F-Site Plan Changes
Wording The site plan as submitted with the shoreline application on April 6, 2004 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated August 4, 2004 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for a shoreline exemption for the Chimacum Creek Estuary Restoration only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Shoreline Master Program Section 3.402.19 and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
