Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Other Work/Separate Approval
Wording Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department.

Title: C-EXPIRATION
Wording This shoreline exemption is valid for 1 year from date that the Corp of Engineers Permit is issued.

Title: C-ENVIRONMENTAL HEALTH
Wording If the applicant proposes to dispose of 3,700 cubic yards of wood chips in an upland location (besides an approved landfill location), a Stormwater Plan for a Medium Project is required from Jefferson County DCD prior to the placement of the wood chips. The disposal area shall not be within shoreline jurisdiction (i.e. within 200 feet of OHWM). A clearance is required from Jefferson County Environmental Health prior to the disposal of the wood chips in any location, except for an approved landfill location.

Title: No Fill or Other Material
Wording No fill or other material may be placed in the waters or intertidal areas of Jefferson County.

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: Comply with HPA
Wording In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval.

Title: Army Corps Check
Wording Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers (COE) in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands. Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on June 14, 2004 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Type 1 stream (Shoreline-Urban), 100 year floodplain, and stormwater.

Title: F-Stormwater
Wording If the applicant proposes to dispose of 3,700 cubic yards of wood waste in an upland location (besides an approved landfill location), which will result in land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Stormwater Plan for a Medium Project prior to the placement of the woodchips.

Title: F-HPA Issued
Wording The Washington Department of Fish and Wildlife issued Hydraulic Project Approval (HPA) for this activity on April 1, 2004 under Log Number ST-F9382-01. The HPA expires on March 31, 2009.

Title: F-Site Plan Changes
Wording The site plan as submitted with the Shoreline Exemption Application on May 21, 2004 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 6, 2004 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for a maintenance dredging of approximately 3,700 cubic yards of wood chips that have fallen into the water at the Port Townsend Paper Mill only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-SEPA AND APPEAL PROCESS
Wording Reviewed under the State Environmental Policy Act (SEPA) by Jefferson County acting as lead agency. Notice of the Shoreline Exemption (SDP 04-00013) and Preliminary Threshold Determination for a Determination of Non-Significance (DNS) utilizing the optional process (WAC 197-11-355) was published in the June 16, 2004 edition of the Jefferson County Port Townsend Leader. On June 16, 2004 notice sent to agencies, the applicant/representative, and surrounding landowners. The site was posted on June 16, 2004. The only comment received was a letter from the WA State Department of Ecology dated June 30, 2004 that indicated that a water quality certification may be required. This is a common requirement when ever a Corp of Engineers Permit is required. The final threshold determination is incorporated into this decision. There is no Administrative Appeal process under the UDC for Type I permit as specified by Section 8.10(12) of the UDC. Appeal of a Type I permit requires a Judicial Appeal as specified by Section 8.5(2) of the UDC.

Title: F-NATURE OF PROPOSAL
Wording The proposal would occur over water and is for maintenance dredging at the Port Townsend Paper Mill. This area was last dredged in 1991. The proposal is for the removal of approximately 3,700 cubic yards of wood chips that have fallen into the water from a .75 acres area. The maintenance dredging would remove between 2-7 feet of wood chips, and would return these areas to their original depths. The removed material would be disposed at an upland location. This area is comprised barge loading, wharf, and warehouse facilities. A Hydraulic Project Approval (HPA) #ST-F9382-01 has been issued on April 1, 2004 by the Washington Department of Fish and Wildlife. A water quality permit may be required from the Washington State Department of Ecology. A permit will be required from the Army Corp of Engineers. This will address all issues related to impacts to Port Townsend Bay. Because this proposal is over water there are no issues to the upland area with the possible exception of the disposal of the wood chips. This is addressed by requiring a stormwater permit and clearance from Environmental Health if the wood chips are not disposed in an approved landfill.

Title: F-LANDFILL
Wording All work will be performed over water, no land disturbance within 200 feet of the OHWM (shoreline jurisdiction) will take place.

Title: F-SDP Exemption Section
Wording The Development Review Division finds that this proposal is consistent with Shoreline Master Program Section 3.402.(6) and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements.
