Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: FINDING: POTENTIAL CAs
Wording The application was reviewed by Jefferson County Permit Center staff on 12/08/00 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: Wetlands, Seismic, Eagle/Osprey Habitat, Shoreline (Natural), Steams (Type 1/2/3/4), Floodplain, Susceptible Aquifer Recharge Area, and adjacent Commercial Forestland (North, West and South).

Title: FINDING: CONFIRMED CAs
Wording Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 3/10/98 and confirmed the existence of the following critical areas and/or their associated buffers on the property: Wetlands, Streams, Susceptible Aquifer Recharge Area, Adjacent Commercial Forestlands, and Eagle Habitat.

Title: FINDING: OTHER RELEVANT INFO
Wording A Wetland Delineation Report was submitted in conjunction with this application. Said report identified the Wetlands as Category I Wetlands (Low Intensity Use). The required setback buffer from the Wetland shall be 75-feet.

Title: FINDING: Aquifer Recharge Area
Wording Aquifer recharge areas in Jefferson County are characterized by porous geologic formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County.

Title: FINDING: Susceptible Aquifer
Wording Susceptible aquifer recharge areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. This includes any portion of Jefferson County with a DRASTIC index of greater than or equal to 180 points as determined using the U.S. Environmental Protection Agency DRASTIC methodology: Drastic: A Standardized System for Evaluating Ground Water Pollution Using Hydrogeologic Settings (EPA 600/23-87-035).

Title: FINDING: Unstable Bluffs
Wording These bluffs are considered unstable and are subject to catatrophic slides. The potential for an earthquake of a high magnitude occuring in western Washington in the near future is considered a high probability by regional experts.

Title: FINDING: Geologically Hazardous
Wording Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms.

Title: FINDING: Forest Land Activities
Wording Designated long term forest lands are located on the north/west and southern adjacent properties, on which a variety of forest related activities may occur that are not compatible with residential development. These activities include spraying, pruning, harvesting, blasting, drilling, rock curshing, and vehicle movements, which can generate dust, smoke, noise and odor. Forest or mining activities performed in accordance with county, state, and federal laws are not subject to legal action as public nuisances.

Title: FINDING: Designated Forest Lands
Wording Designated commercial forest lands are located on the North/West and Southern adjacent properties. According to the Jefferson County Interim Forest Lands Ordinance (Ordinance No. 01-0121-97), buffer and development restrictions are required on property located adjacent to designated forest lands. A 500-foot setback shall be maintained from the property line to the proposed development.

Title: FINDING: Shoreline areas
Wording This waiver also includes findings and conditions for evaluation of shoreline areas as regulated under the provision of The Jefferson County Shoreline Management Master Program, adopted March 7, 1988, as amended.

Title: FINDING: Shoreline setback
Wording The standard setback for residential structures, including common appurtenant structures such as garages and workshops, shall be 30 feet, or 1 foot for each foot of bank height, whichever is greater. This setback shall be measured from the bank's edge when the bank height exceeds 10 feet.

Title: CUSTOM FINDING
Wording A setback buffer of 30-feet shall be maintained from the top of the landslide bluff to the proposed manufactured dwelling.

Title: WETLANDS SETBACK CONDITION
Wording A setback of 75-feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing or other alteration of the wetland or its buffer is allowed.

Title: NO WETLAND BUFFER ALTERATION
Wording No alteration shall be made to the wetland or its buffer without prior authorization by the Critical Area Administrator. Buffer enhancement is allowed as long as native species are selected for planting.

Title: MARK WETLAND BUFFER
Wording Prior to and during approved construction activities, the perimeter of the wetland buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Wetland and Buffer - Do not Remove or Alter Existing Native Vegetation."

Title: SEPARATE WETLAND BUFFER
Wording The applicant shall permanently separate the upland boundary of the wetland buffer from the remainder of the subject property through installing and maintaining one of the following; logs, trees, a hedge row, or other prominent physical marking. The separation method identified by the applicant shall be approved by the Critical Area Administrator prior to planting or installation.

Title: CONSTRUCTION ACTIVITIES
Wording All construction activities, including the storage and preparation of materials, shall not encroach upon the designated wetland, or its associated buffer.

Title: NATIVE PLANTS-CONIFERS
Wording Among the native conifer species which may be used are: grand fir (Aibes grandis), sitka spruce (Picea sitchensis), shore pine (Pinus contorta), Douglas-fir (Pseudotsuga menziesii), western redcedar (Thuja plicata), western hemlock (Tsuga heterophylla).

Title: NATIVE PLANTS-BROAD LEAF
Wording Among the native tree species which may be used are: vine maple (Acer circinatum) big-leaf maple (Acer macrophyllum), red alder (Alnus rubra), Pacific madrone (Arbutus menziesii), quaking aspen (populus tremula), black cottonwood (Populus trichocarpa), bitter cherry (Prunus emarginata), Oregon white oak (Quercus garryana), cascara (Rhamnus purshiana), Pacific willow (Salix lasiandra), Scouler's willow (Salix scouleriana).

Title: NATIVE PLANTS-SHRUBS

Title: VEGETATIVE BUFFER
Wording A vegetive buffer of 30 feet shall be permanently maintained from the top or edge of the landslide hazard area. All buffers shall be measured perpendicularly from the top of the landslide hazard area.

Title: LANDSLIDE BUFFER
Wording Landslide hazard areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator.

Title: FISH & WILDLIFE CUSTOM COND
Wording A setback (buffer) of 25 feet, measured perpendicularly from the ordinary high water mark along the bank shall be permanently maintained as a fish and wildlife habitat area along the identified Type 3 Stream.
