Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: FINDING: POTENTIAL CAs
Wording The application was reviewed by Jefferson County Permit Center staff on 7/1/98 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: potential landslide hazard, wetlands, seismic hazard, aquifer recharge.

Title: FINDING: CONFIRMED CAs
Wording Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 7/1/98 and confirmed the existence of the following critical areas and/or their associated buffers on the property: landslide hazard.

Title: FINDING: SFR & BMPs
Wording The construction of a single family residence is not considered a high impact land use, therefore the proposed structure is not subject to Aquifer Recharge Area regulations at this time. However, when Best Management Practices are adopted by the Jefferson County Board of Commissioners, there may be some rules and/or recommendations which apply to the future development of the subject property regarding Aquifer Recharge protection (please see enclosed copy of DRAFT Best Management Practices rules).

Title: FINDING: Geotechnical Report
Wording An applicant submitting a triggering application shall submit, and have approved, a geotechnical report as specified in Section 11 (Special Reports) of the Jefferson County Interim Critical Areas Ordinance when the triggering application involves any of the following: (a) The alteration of landslide hazard area or its buffer; (b) The creation of a new parcel within a known landslide hazard area; (c) The construction of a publicly owned facility in a designated seismic hazard area.

Title: FINDING: Report Responsibility
Wording All special reports shall be the responsibility of the applicant, including payment of costs incurred for report preparation, and review by County personnel. A Special Report Fee is charged by the County and must be submitted prior to the County's review of such report.

Title: DRAINAGE & EROSION RESIDENTIAL
Wording The applicant shall develop and submit to the Permit Center for approval, a "Small Parcel Erosion Control Plan" (see enclosures). Once the subject permit has been issued, the applicant shall fully implement the provisions of the submitted "Small Parcel Erosion Control Plan." A Certificate of Occupancy will not be issued until the Permit Center verifies plan compliance.

Title: DIRECTIONAL FELLING
Wording Damage to vegetation to be retained on site shall be minimized by directional felling of trees away from these areas.

Title: LANDSLIDE BUFFER
Wording Landslide hazard areas (steep slopes) and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator.

Title: SURFACE DRAINAGE
Wording Surface drainage shall not be directed across the face of a marine bluff, landslide hazard or ravine. If drainage must be discharged from a bluff to adjacent waters, it shall be collected above the face of the bluff and discharged to the water by tight line drain and provided with an energy dissipating device at the shoreline. A shoreline permit is required to discharge water at the shoreline.

Title: GEOTECH REPORT
Wording Prior to construction of any structures, the applicant shall submit and have approved a geotechnical report as specified in Section 11 of the Critical Areas Ordinance.

Title: GEOTECH REPORT CONTENTS
Wording The geotechnical report shall certify all of the following: (a) There is minimal landslide hazard as proven by a lack of evidence of landslide activity in the vicinity in the past; (b) An analysis of slope stability indicates that the proposal will not be subject to risk of landslide, or the proposal or the landslide hazard area can be modified so that hazards are eliminated; (c) The proposal will not increase surface water discharge of sedimentation to adjacent properties beyond predevelopment conditions; (d) The proposal will not decrease slope stability on adjacent properties; and (e) All newly created building sites will be stable under normal geologic conditions (if applicable).

Title: SPECIAL REPORT REQUIREMENTS
Wording Special reports for critical areas shall include a scale map of the development proposal site and a written report. The special report shall identify and characterize any critical area as a part of the larger development proposal site, assess impacts of the development proposal on any critical areas on or adjacent to the development proposal site, and assess the impacts of any alteration proposed for a critical area. The special report shall propose adequate protection mechanisms that may include mitigation, maintenance and monitoring plans, and performance surety. Special reports shall include documentation certifying the qualifications of the Preparer.
