Case Conditions
Below is a list of conditions for this permit case. Conditions typically record requirements that the applicant must meet to be in compliance with the permit.
Title: Minimum Stdrds Satisfied Cond.#3
Wording The administrator hereby waives the requirement for a special report and finds the applicant has successfully demonstrated that the proposal involved in the triggering application will not affect the critical area in a manner contrary to the goals, purposes and objectives of Ordinance No. 05-0509-94, the JEFFERSON COUNTY CRITICAL AREAS ORDINANCE, and the minimum protection standards required by this ordinance are satified.

Title: FINDING: POTENTIAL CAs
Wording The application was reviewed by Jefferson County Permit Center staff on 7/25/94 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: fish and wildlife habitat area, landslide hazard area.

Title: FINDING: CONFIRMED CAs
Wording Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 7/29/94 and confirmed the existence of the following critical areas and/or their associated buffers on the property: fish and wildlife habitat area, landslide hazard area.

Title: FINDING: OTHER RELEVANT INFO
Wording Following the staff site visit on 7/29/94, applicant's permit was approved without conditions because building site, as shown on the Universal Plot Plan did not encroach on either buffer for the two above mentioned critical areas. On 8/24/94, staff visited the site to inspect a foundation location prior to pouring and learned that the foundation had been moved by 15 feet, encroaching upon the 30 foot buffer for the landslide hazard area.

Title: GEO HAZARD CUSTOM CONDITION
Wording According to Section 9.506 of the Ordinance, the standard buffer width of 30 feet shall be established from the top of all edges of landslide hazard areas. According to Section 9.507, the Critical Areas Administrator may reduce the buffer width if the applicant can demonstrate that such reduction will not adversely affect the critical areas. Under no circumstances may the buffer be reduced to less than 10 feet. Applicant has relocated home site, reducing the buffer width from 30 feet to 15 feet. Staff has determined that this is considered adequate to protect critical areas but should be subject to the following conditions.

Title: DRAINAGE & EROSION
Wording According to Section 9.502, once the applicant has encroached upon the buffer area, the applicant is required to submit and have approved, a Drainage and Erosion Control Plan. The applicant shall fully implement the provisions of the submitted Drainage and Erosion Control Plan, and contact the Jefferson County Public Works Department to arrange a schedule of inspection for plan compliance.

Title: RE-VEGETATION
Wording Areas of the subject property where vegetation has been removed or disturbed and not identified for coverage with impervious materials as part of the regulated activity, shall be hydroseeded prior to occupation or final inspection of the completed project.

Title: CONSTRUCTION ACTIVITIES
Wording All construction activities, including the storage and preparation of materials, shall not encroach upon the designated geologically hazardous area, or its associated buffer.

Title: VEGETATION RETAINED
Wording Vegetation retained on-site following completion of clearing for roadways, utilities and the like, may be cleared only if such clearing is necessary to complete the proposal (Note: This condition should not be construed as allowing removal of native vegetation within a designated critical area or its associated buffer). Specifically, no vegetation is to be removed on the slope which drops down to Chimacum Creek. Downed logs on hill side should remain in place.

Title: SEPARATE BOUNDARY
Wording The applicant shall permanently separate the boundary of the landslide hazard area buffer from the remainder of the subject property through installing and maintaining one of the following; logs, trees, a hedge row, or other prominent physical marking to be placed at the top of the slope. The separation method identified by the applicant shall be approved by the Critical Area Administrator prior to planting or installation. Applicant is also required to enhance the slope leading to Chimacum Creek by planting with not less than 15 additional native trees for increased bank stabilization and wildlife habitat enhancement. Staff recommends a mixture of native plants which may include western redcedar, Douglas fir, vine maple, madrone, or other upland species common to East Jefferson County. A planting design and schedule shall be submitted to the Permit Center for approval, and final approval of the entire proposal is subject to completion of each of the above requirements to the satisfaction of the County.

Title: LANDSLIDE/VEGETATION
Wording Landslide hazard area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator.

Title: DO NOT ALTER LANDSLIDE BUFFER
Wording No alteration shall be made to the landslide hazard area buffer without prior authorization by the Critical Area Administrator.

Title: FISH & WILDLIFE CUSTOM COND
Wording Movement of foundation did not encroach upon the buffer area for fish and wildlife habitat.
