Title: Bld Security/hooded lights
Wording Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way.

Title: Bld Exterior height lights
Wording Exterior lighting for commercial and industrial uses shall not exceed thirty feet (30') in height from the finished grade. Ground level lighting is encouraged.

Title: NONRESIDENTIAL SEPTIC
Wording This change of use is for RETAIL only having, according to the owner, 1-2 employees on site, 7 days per week, for between 12 to 14 hours per day, depending on the season and success. There is no approval or intent for the public to use the bathrooms on site. The kitchen is planned for an employee break room only.

Title: FUTURE APPROVALS FOR SEPTIC
Wording Any future submittal for changes to the operation will require at least 1 year of water use records and waste strength testing results for BOD, TSS, Oil and Grease to evaluate the capacity of the existing use.

Title: PARKING
Wording Off street parking shall be provided in accordance with the minimum standards set forth in Tables 6-2 & 6-3 of JCC 18.30.100. Parking space requirement for Retail Sales and Services is 1 space per 300 square feet. The proposed retail space is approximately 2700 square feet, requiring 9 spaces;. one parking space is required for each employee, requiring two spaces; and one additional ADA accessible parking space. Total required parking is 12 spaces, as shown on the Parking plan.

Title: NOISE
Wording The intensity of sound emitted by any commercial or industrial activity shall not exceed levels estabished by the Washington State Department of Ecology under WAC 173 60, and by Jefferson County under Resolution No. 67 85, "Establishment of Environmental Designations for Noise Abatement Areas for Jefferson County."

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Wording The septic capacity for this property (SEP2017-00163) is sized for 360 gallons per day peak flow. Assumed proposed use is less than 100 gallons per day.

Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-SIGN APPROVAL
Wording The Change of Use permit review includes the existing sign, which is to be used for the new business. The sign is an onsight, freestanding, commercial sign supported by two upright posts and is 8'4" (110") high, with a total square footage sign area of 20 sqare feet. Each side of the sign is illuminated by solar lights mounted to the top of the sign and directed downward and away from traffic. The sign meets design standards of JCC 18.30.150(6).

Title: F-LANDSCAPE SCREENING PLAN
Wording A landscape screening plan was submitted and coordinated with DCD regarding site limitations and screening strategies. North and West property lines are abutting a residential use and require Screen-A landscape screening. East and South property lines abut the commercial zone and require Screen-C landscape screening as follows: Screening needs to be by landscaping following JCC 18.30.130. Privacy fencing will not meet these landscape screening requirements. JCC 18.30.130(5) Landscaping of Interior lot lines. West & North Property Lines (interior lot lines abutting residential zone) need to meet subsection (5)(a) of Screen-A landscaping. “Fifteen feet of Screen-A landscaping shall be included in all commercial, industrial, or small-scale recreational and tourist development along any portion adjacent to a residential use or district.” Screen-A is defined as a “full screen” that functions as a visual barrier. This landscaping is between residential and nonresidential areas and shall at a minimum consist of a mix of primarily evergreen trees and shrubs generally interspersed to form a continuous year-round screen that grows to at least eight feet in height within two growing seasons. Shrubs planted on North property line are adequate if they fill-in and create the “Screen-A” conditions of 8-feet height in two growing seasons. The septic drainfield is a consideration here and plantings should not interfere with the septic drainfield, so the 15-foot depth of plantings on this property line, called out by (5)(a) can be narrower than 15-feet. Here, the tall-growing shrubs are designed to satisfy the planting requirement (without adding additional trees). West property line—provide 15-feet depth of “Screen-A” landscape screening as defined per code (JCC 18.390.130(3)(a)) and defined above, “full screen” that functions as a visual barrier. This landscaping is between residential and nonresidential areas and shall at a minimum consist of a mix of primarily evergreen trees and shrubs generally interspersed to form a continuous year-round screen that grows to at least eight feet in height within two growing seasons. JCC 18.30.130(4) Landscaping Road Frontages. East and South property lines abut road frontages. These property lines shall be provided with “Screen-C“ landscaping. JCC 18.30.130(3)(c) “a ‘see-through screen’ that functions as a partial visual separator to soften the appearance of parking areas and building elevations. This landscaping is typically found along road frontage or between multiple-family developments and shall, at a minimum, consist of: a mix of evergreen and deciduous trees or shrubs generally interspersed to create a continuous canopy.” East property line (Rhody Drive) Screen-C. There are sight-distance concerns for vehicle operators pulling out from W. Foster Street. As discussed, any landscape screening that protrudes above the existing 4-foot fence is not advised along the property line from the W. Foster St. property corner to the location of the business sign (just north of the building east entryway). We agreed on 4 plantings interspersed along the E. property line between the business sign area and the NE property corner. South property line (W. Foster Street) Screen-C. DCD agreed that there will be 5 plantings interspersed between the SE property corner to the driveway at the SW corner. Plantings should be avoided right at the SE property corner because of sight distance issues discussed above.

Title: F-I-502 BUFFER SETBACK
Wording The marijuana retail location is outside of the 1000-foot marijuana buffer from schools and parks.

Title: F-Confirmed ESAs
Wording The Geographic Information Systems mapping review identified [and/or a site inspection confirmed] the following Critical Areas on the subject property: Critical Aquifer Recharge Area -- Special Aquifer Recharge Protection Area +Susceptible Recharge Area. .
