Title: CONFIRMED CA’S
Wording The application was reviewed by the Jefferson County Department of Community Development staff on May 22nd, 2017 for the potential presence of Critical Areas under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following Critical Areas were confirmed to be present on the subject property: Type F Stream, Fish and Wildlife Habitat Conservation Area, Wetlands, Seismic Hazard Area, FEMA Flood Zone, Susceptible Aquifer Recharge Area.

Title: AQUIFER RECHARGE AREA
Wording Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County.

Wording Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers.

Title: GEOHAZARD AREA SEISMIC
Wording Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms.

Title: ADJACENT FOREST LAND DISCLOSURE
Wording Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500) feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal of manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations.

Title: STREAMS
Wording A Type F Stream (Fish and Wildlife Habitat Conservation Area) has been identified on the subject property. The stream will require a buffer of 150 feet. The buffer shall be measured horizontally from the Ordinary High Water Mark (OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established.

Title: BUFFERS
Wording Stream and Wetland Buffers are areas that shall be maintained in their natural condition, however, minor pruning or alteration of vegetation may be permitted as long as the function and character of the buffer are not diminished.

Title: MEDIUM STORMWATER
Wording The applicant is proposing to create or add 3,600 square feet of impervious surface and 3,650 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require the project applicant submit a stormwater plan meeting Minimum Requirements #1 through #5 of the Department of Ecology Stormwater Management Manual for Western Washington. The stormwater plan shall address measures to control stormwater, erosion and sediment during construction and shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: WETLAND REPORT SUBMITTED
Wording A Wetland Delineation, Buffer Reduction, and Revegetation Plan Report dated January 2015 was submitted January 27, 2015 in conjunction with MLA14-00093. The report addressed the Category II wetlands and removal of wetland fill placed in the wetland and buffer, and specified the 75 foot buffer. The location of the proposed new development is within the area specified in the submitted report, and shall apply to the proposed greenhouse.

Title: SECURITY CAMERAS
Wording Any security cameras proposed for a recreational marijuana facility shall be positioned so as to not intrude on the privacy of adjacent parcels.

Title: SECURITY FENCE
Wording Any fence eight feet or taller shall be located a minimum 25 feet from all parcel and property lines.

Title: COMPLY WITH OPERATIONS PLAN
Wording The proposed new greenhouse for recreational marijuana production only shall comply with the existing approved Washington State Liquor Control Board producer/processor Operations Plan.

Title: LANDSCAPING INSTALLED
Wording The required landscaping shall be installed prior to project occupancy. A site visit to confirm that landscaping has been installed correctly shall be required prior to final certificate of occupancy. Contact DCD planner Pat Hopper at (360)379-4462 or (360)379-4450 to schedule a site visit. Fees may be applicable. The required landscaping shall be installed prior to project occupancy. However, a certificate of occupancy may be issued prior to installation of the required landscaping if a bond or other form of appropriate surety is posted in a manner acceptable to the administrator. The time limit for compliance may be extended to allow installation of such required landscaping during the next planting season.

Title: LANDSCAPE SCREENING REQUIRED
Wording The Landscape screening shall be installed as follows: Screen-A” landscaping: Is a “full screen” that functions as a visual barrier. This landscaping is typically found between residential and nonresidential areas; shall at a minimum consist of: A mix of primarily evergreen trees and shrubs generally interspersed to form a continuous year-round screen that grows to at least eight feet in height within two growing seasons.

Wording All landscaping and necessary support systems shall be maintained for the life of the project. All landscape materials shall be pruned and trimmed as necessary to maintain a healthy growing condition. Landscape areas shall be kept free of trash.

Title: Do Not Disturb Buffer
Wording All construction activities shall not encroach upon the 75 foot wetland buffer. This includes the storage or preparation of materials.

Title: Wetland Setback
Wording A setback of 75 feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing, or other alteration of the wetland or its buffer is allowed.

Title: Identify Wetland Buffer
Wording A permanent physical separation along the upland boundary of the wetland buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator.

Wording Approval of this permit does not provide any assurance of future approvals for onsite sewage disposal on the property or use of any existing septic systems. Actions taken to date and proposed as part of this project may limit or prevent future development of an onsite sewage system. Future proposals must meet current code at the time of application.

Wording The submittal shows all development located outside of the reduced wetland buffer. Proposed plans submitted with the application do not indicate any potential temporary impacts to the buffer during construction (which would trigger mitigation). However, the proposed development has the potential to affect the adjacent wetland and wetland buffer if these areas are used during construction to access work areas.
