Case Conditions

Title: CONSTRUCTION ENTRANCE BMP C105
Wording Sediment shall not be allowed onto the roadway of Eaglemont Road. If the construction entrance is not preventing sediment from being tracked onto the roadway pavement, then alternative measures to keep the streets free o fsediment shall be used. This may include street sweeping, an increase in the dimensions of the entrance, or the installation of a wheel wash. Any sediment that is tracked onto pavement shall be removed by shoveling or street sweeping. The sediment colected by sweeping shall be removed or stabilized on site. The pavement shall not be cleaned by washing down the road, except when sweeping is ineffective and there is a threat to public safety. If it is necessary to wash the road, the construction of a small sump shall be considered. The sediment would then be washed into the sump where it can be controlled. If vehicles are entering or exiting the site at points other than the construction entrance, fencing shall be installed to control traffic (BMPs C103 & C104).

Title: FOLLOW WETLAND REPORT GUIDANCE
Wording The applicant shall implement the approved Wetland Delineation, Buffer Reduction, and Revegetation Plan (submitted January 27, 2015). It is the responsibility of the applicant to ensure that livestock do not trample the planted areas. Once the mitigation proposal has been implemented, the applicant shall contact DCD for review and approval of the mitigation area. A FINAL BUILDING CERTIFICATE OF OCCUPANCY SHALL NOT BE ISSUED UNTIL DCD HAS REVIEWED AND APPROVED THE MITIGATION AREA.

Title: MITIGATION PLANTINGS SPECIFIED
Wording Mitigation plants are specified in the wetland report, Table: Treehawk Farms Plant List, p.3. Any plant substitutions shall require approval by DCD prior to installations. Landscaping varieties and non-native species are not acceptable substitutions.

Title: INSPECTION OF PLANTINGS
Wording After fencing is installed and after plantings have been installed, contact DCD (360) 379-4450 to schedule a site inspection of the mitigation plantings.

Title: SWPPP INSTALL B/F FILL REMOVAL
Wording Prior to removing wetland & buffer fill, contact DCD (360) 379-4450 for a site inspection of the Stormwater Pollution Prevention Plan (SWPPP) installation. Per Chapter 90.48 RCW State Water Pollution Control Act, turbid waters cannot be discharged into wetlands, which are waters of the state.

Title: FINAL GRADE AND SWPPP INSPECTION
Wording Prior to plantings and prior to fence installation, contact DCD (360) 379-4450 for a site inspection of the fill removal, final grade and inspection of the Stormwater Pollution Prevention Plan (SWPPP) installation.

Title: WETLAND BUFFER REDUCTION
Wording The Category II wetland buffer is reduced from 100 feet to 75 feet by a successful implementation of the Buffer Reduction and Revegetation Plan, p. 4 of the Wetland Report, which includes an enhancement of a 40-foot by 150-foot area by removing fill and planting over 75 native trees and shrubs in the revegetation area shown on Sheet #4 of the Plan.

Title: Do Not Disturb Buffer
Wording No construction activities shall encroach upon the wetland buffer. This includes the storage or preparation of materials.

Title: Wetland Setback
Wording A setback of 75 feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing, or other alteration of the wetland or its buffer is allowed.

Title: Identify Wetland Buffer
Wording A permanent physical separation along the upland boundary of the wetland buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator.

Title: Mark Wetland Buffer Drng Cnstrctn
Wording Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100) feet, whichever is less. Signs shall contain the following statement: "Wetland & Buffer - Do Not Remove or Alter Existing Vegetation."

Title: BMPs
Wording The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Title: WRIA-Reserve Management Area
Wording The project is located within WRIA 17 and thus could be subject to compliance with the WA State Department of Ecology In Stream Flow Rule for that region. The parcel is located within the Chimacum sub-basin in a designated Reserve Management Area. The applicant has provided documentation for determining that they have a permit exempt well. According to correspondence from Vicki Cline, Compliance & Enforcement, Water Resources Program, Southwest Regional Office, the Department of Ecology cannot validate or invalidate water right claims, but can provide a response that the information provided by the applicant shows that there is historical water use, and it seems reasonable to assume that there may be active water rights represented by the applicant's claims. The documentation has sufficiently documented a history of water use for domestic supply, stock watering, irrigation of hay crop and pasture areas along with good estimates of gallons used and acres irrigated, as well as stock water numbers and uses. Department of Ecology strongly recommends that measuring devices be installed on the well source and the diversion from the creek. By installing measuring devices the water usage can be better documented, which can then show "continuous use and extent" in more detail. Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on 6/1/2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Fish and Wildlife Habitat Conservation Areas (FWHCA)--Fish-bearing streams, Wetlands, Seismic Hazard, Flood Zone A, and Susceptible Aquifer Recharge Area. ESAs in the project area are limited to wetlands and Seismic Hazard.

Title: F-Special Report Submitted
Wording A Wetland Delineation, Buffer Reduction, and Revegetation Plan Report dated January 2015 was submitted January 27, 2015 in conjunction with the application to address the Category II wetlands and removal of wetland fill placed in the wetland and buffer.

Title: F-Adjacent Forest Land Disclosure
Wording Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500) feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations.

Title: F-Stormwater
Wording The applicant is proposing to create or add 3,900 square feet of impervious surface and 6,400 square feet of land disturbing activities. Jefferson County Unified Development Code 18.30.070 requires that your proposal submit a Stormwater Site Plan for a Medium project, meeting Requirements #1 through #5 of the Stormwater Management Manual for Western Washingtion, Dept. of Ecology, 2012. The stormwater plan shall address measures to control stormwater, erosion and sediment during construction and shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. To demonstrate compliance with Requirements #1-#5, the applicant has submitted a Stormwater Calculation Worksheet, Stormwater Site Plan Narrative and an Erosion and Sediment Control Site Plan. The Stormwater Site Plan was approved by DCD July 20, 2015. All temporary sedimentation and erosion control measures, and protective measures for critical areas and significant trees, shall be installed prior to initiating any construction activities. Full dispersion BMP for driveway and parking areas shall be accomplished by sheet flow and shall be designed to minimize collection and concentration of runoff.

Title: F-SEPA Exempt
Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to locally adopted thresholds in 18.40.750 and pursuant to WAC 197-11-800 (1)(b)(iv) commercial building with 12,000 s.f. gross floor area and 40 parking spaces; WAC 197-11-800(1)(b)(v) landfill and excavation of 500 cu.yds.; and WAC 197-11-800 (6)(a) land use decisions (Change of Use) for exempt projects.

Title: F-Site Plan Changes
Wording The revised site plan as submitted with the Interior Remodel, Change of Use, and Fence & Stormwater Permit applications on May 8, 2015 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 20, 2015 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is for a Change of Use for an Agriculture Structure (ZON14-00047), an 8-foot sight-obscuring fence and a Stormwater Permit (BLD14-00412) only. Approval for associated Interior Remodel permit (BLD14-00413) has already been issued. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: ZONING
Wording The parcel has been designated as Prime Agricultural Lands (AP-20) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998, as amended.

Title: F-General PMT Notice
Wording NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that "takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat" for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: - All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees - Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet (1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist.
