Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-STORMWATER
Wording On January 5, 2011 the Jefferson County Department of Public Works commented as follows: Stormwater runoff from the project site will be collected and treated by the PTPC’s existing stormwater controls and process water system. Public Works has no recommendations for additional stormwater management requirements.

Title: F-LETTER FROM AW 12/22/2010
Wording Annika Wallendahl, Environmental Manager for Port Townsend Paper, submitted a letter dated 12/22/2010, regarding PTPC Stormwater Summary. It states: The Truck Tipper Project area is either already paved, existing gravel/dirt roadway, or storage area for chip piles. No vegetation will be cleared for this project. The Truck Tipper project construction stormwater will be managed by existing permanent stormwater controls that are already in place. PTPC stormwater is managed under the site's NPDES permit WA-000092-25. Stormwater in the Truck Tipper area, and the mill site, is either infiltrated or collected and sent with process water to the primary and secondary effluent treatment system. Treated effluent is discharged via NPDES outfall 001.

Title: F-OUT OF SHORELINE JURISDICTION
Wording The proposed truck tipper is more than 200 ft. from the ordinary high water mark of the marine shoreline and is outside of the Shoreline Master Program jurisdiction.

Title: F-PROPOSAL OUTSIDE OF FLOOD AREA
Wording The project is located outside the flood hazard area as mapped on FEMA Firm # 5300690160B.

Title: F-NO GEOTECH REPORT
Wording The location for the proposed truck tipper and the revised driveway is on disturbed soils much of which has already been paved. The area is flat and away from steep slopes. Staff determined no geotechnical report is required.

Title: F-ACCESS
Wording Mill Road (C698619) is a county local access road. A road approach is existing and an address of 100 Mill Road has been assigned to the parcel.

Title: F-REVISED SITE PLAN
Wording The revised site plan as submitted on December 23, 2010 shows a "Temporary Interlocking Concrete Block Wall". On January 18, 2011 the Port Townsend Paper Corporation informed staff the size of this wall will be 70 feet long, 5 feet high, 2.6 feet wide. On February 2, 2011, the building department determined a building permit is required for this structure.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on 12/22/2010 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Shoreline Designation: Urban, Shoreline Slope Stability: Modified, Stable, Unstable, Seismic Hazard Area, Erosion Hazard Area (small portion to the north), Susceptible Aquifer Recharge Area (SUSC).

Title: F-DNS Issued
Wording Reviewed under the State Environmental Policy Act (SEPA) by State of Washington Department of Ecology acting as lead agency. Determination of Non-Significance (DNS) issued on September 23, 2010.

Title: F-Site Plan Changes
Wording The revised site plan as submitted on December 23, 2011 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated February 3, 2011 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-Approval for _____ Only
Wording This approval is to add one new truck tipper, grading for revision to the driveway & temp interlocking concrete block wall only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: ZONING
Wording The parcel has been designated as Heavy Industrial under the Jefferson County Comprehensive Land Use Map effective August 28, 1998.

Title: F-General PMT Notice
Wording NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that "takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as "critical habitat" for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: - All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees - Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service.
