Case Findings
Below is a list of findings for this permit case. Findings typically record facts that the staff are using as the basis of their permit processing decisions.
Title: F-UDC SECTION 3.6.5
Wording This proposal is not subject to the voluntary and mandatory actions identified in UDC Section 3.6.5.d(9)iii as the structure is existing and proof of potable water is not required for this application.

Title: F-SHORELINE/UDC 4.26.6
Wording Per UDC Section 4.26.6, unless specifically provided otherwise, any nonconforming structure or use under the jurisdiction of the Shoreline Master Program shall be subject to the nonconforming use provisions in WAC 173-27-080. Per the Shoreline Master Program for Jefferson County and Port Townsend, Washington adopted March 7, 1989, shoreline jurisdiction includes lands located within 200 feet of Ordinary High Water Mark (OHWM). While a portion of the hotel structure is within shoreline jurisdiction, the proposed addition is located outside of shoreline jurisdiction and is not subject to the Shoreline Master Program. The proposal is consistent with this standard.

Title: F-COMP PLAN DESIGNATION
Wording This parcel is a legal nonconforming parcel designated Rural Residential 1:5 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998.

Title: F-SECTION 4.26.2.B(1) REVIEW
Wording The hotel use is a legal nonconforming use subject to Unified Development Code Section 4.26.2.b(1) which allows a structure housing a legal nonconforming use to be enlarged and/or expanded if the structure (in its enlarged or expanded state) meets all applicable bulk, dimensional and lot coverage requirements for the land use district in which the use is located. Expansion of the structures housing legal existing nonconforming uses up to 10% of the existing bulding size, or 200 square feet, whichever is greater, shall be subject to a Type I administrative approval process. This proposal is to expand the existing hotel footprint of 24,192 sqare feet by 1,620 square feet. The expansion constitutes a 6.7% increase. The proposal is consistent with UDC Section 4.26.2.b(1).

Title: F-UDC 4.26.8/AIRPORT
Wording Per UDC Section 4.26.8, no structures or obstructions of any kind or nature whatsoever constituting a nonconforming use shall be rebuilt, repaired, or replaced where such repairing, rebuilding, or replacement constitutes an airport hazard. This structure and the proposed expansion are not airport hazards. The proposal is consistent with this criteria.

Title: F-UDC SECTION 4.26
Wording As this application proposes expansion of a structure housing an existing legal nonconforming use, the criteria and standards identified under UDC Section 4.26 numbers 1, 2.a, 2.b(2), 3, 4, 5, and 7 are not applicable to this proposal. The proposal is consistent with UDC Section 4.26.

Title: F-LANDSCAPING SCREENS
Wording "Screen-A" landscaping is a "full screen" that functions as a visual barrier. This landscaping is typically found between residential and non-residential areas. "Screen-A" landscaping shall at a minimum consist of a mix of primarily evergreen trees and shrubs generally interspersed to form a continuous year-round screen that grows to at least eight (8) feet in height within two (2) growing seasons. "Screen-C" landscaping is a "see-through screen" that functions as a partial visual separator to soften the appearance of parking areas and building elevations. This landscaping is typically found along road frontage or between multiple-family developments. "Screen-C" landscaping shall at a minimum consist of a mix of evergreen and deciduous trees or shrubs generally interspersed to create a continuous canopy.

Title: F-PARKING
Wording Parking shall be provided determined by the calculation of one parking space per guest room plus one per employee for the hotel. Additional parking shall be provided for physically handicapped needs at a rate of not less than 2% of the total number of parking spaces, or a minimum of one parking space. A worksheet outlining the parking available to each use on the parcel has been provided by the applicant. Title: F-ACCESS
Wording Hadlock Bay Rd is a county local access road identified as C654109. The road approach is existing, and an address of 310 Hadlock Bay Rd has been assigned to the parcel.

Title: F-Confirmed ESAs
Wording The application was reviewed by the Jefferson County Department of Community Development staff on June 30, 2004 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Coastal Seawater Intrusion Protection Zone (SIPZ) and Urban shoreline designation.

Title: F-Stormwater
Wording The applicant is proposing to create or add no net new impervious surface and 64 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal comply with Minimum Requirement #2 (Construction Stormwater Pollution Prevention) of the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems.

Wording Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(1)(b)(iii).

Title: F-Site Plan Changes
Wording The site plan as submitted with the building application on June 24, 2004 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated September 1, 2004 shall be resubmitted for review and approval by Jefferson County Department of Community Development.

Title: F-APPROVAL FOR EXP ONLY
Wording This approval is for an interior expansion and commercial addition only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.

Title: F-LANDSCAPING PLAN
Wording Fifteen (15) feet of Screen-A landscaping shall be included in all commercial, industrial, or small-scale recreational and tourist development along any portion adjacent to a residential use or district. An average width of ten (10) feet of Screen-C landscaping shall be provided along Hadlock Bay Rd. The Administrator has determined the proposed landscaping plan is sufficient for the proposed expansion.

Title: F-IMPERVIOUS SURFACE
Wording Maximum lot coverage in the Rural Residential land use designation is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. The existing impervious surface covers 64% of the site. No new impervious surface is allowed on this parcel under this application. Subject to condition, the proposal is consistent with this criteria.
