The moratorium that was flagged related to this permit application was determined to be inapplicable due to the following findings. (1) The property is not being converted to a non-forestry use. Commercial timber growing is the ongoing dominant use of the property. (2) The property is not being converted to an active use that is incompatible with timber growing. The Jefferson County Forest Lands Ordinance (Section 8.10, Permitted Uses) lists telecommunication facilities as permitted uses in the Commercial and Rural Forest zones; and (3) The moratorium covers the SW 1/4 of Section 31, T28N, R1E. The wireless communication tower is proposed to be located in the NW 1/4 of Section 31, T28N, R1E. Based on the above findings, and the advise of the Jefferson County Prosecuting Attorney's Office, the Department of Community Development Director and Project Planner have determined that the subject building permit can be issued.
